Visa and Residence Overstay in Türkiye in 2026: Fines, Departure and Entry Bans
An overstay occurs when someone remains beyond the stay permitted by their visa, visa exemption, residence permit or work authorisation without another lawful basis. Consequences can include a fine, removal proceedings and an entry ban. Duration, how departure occurs, payment and other decisions affect the outcome.

Practical overview
| Measure | What does it determine? | Record to request or retain | Effect of payment |
|---|---|---|---|
| Overstay fine or financial assessment | The amount payable for the particular case under the official assessment; this is distinct from an entry-ban decision. | An available assessment or breakdown, followed by the official payment receipt. | The receipt evidences payment of the amount stated; do not assume it settles other debts or charges. |
| Entry ban or admission restriction | A decision or restriction affecting future admission, according to its grounds, conditions and duration. | A copy of the decision or available official information about its grounds, duration and notification. | Paying the fine does not automatically cancel the ban or independent restrictions. |
| Removal decision | A separate decision concerning removal, with its own grounds, procedure and remedies. | The decision, its notification date and the departure and challenge information it contains. | Payment of a charge does not mean the removal decision has been cancelled; the decision itself must be checked. |
Identify when lawful stay ends
Common situations include exceeding visa/visa-free days or the 90-in-180 rule, remaining after residence expiry without a valid timely renewal, failing to leave following refusal/cancellation, expiry/cancellation of the work-based residence right, or missing an official departure deadline. The visa sticker’s validity alone is not the permitted duration of stay. Where the 90 days in any 180 days rule applies, count all presence in the rolling 180-day period. A brief trip abroad does not reset the allowance.
Residence renewal opens during the final 60 days and must be submitted before expiry. A late application may leave an unlawful period subject to assessment and penalties; acceptance is not guaranteed. An ordinary valid work permit generally provides a residence basis. Work permits issued to international protection applicants, conditional refugees or people under temporary protection do not substitute for residence permits and do not convert protection status into ordinary residence. Once it ends, a separate valid status is needed unless the applicable renewal rules lawfully cover the person.
Work out the relevant dates
Establish the final lawful day, actual departure, previous visa/residence/work basis, any timely renewal, refusal/cancellation and service date, official departure period and passport entry/exit records. Use official records: even a small date error can affect the overstay band.Match each situation to its dates and records
| Situation | Date or record to check | What not to assume |
|---|---|---|
| Visa or visa exemption | Visa conditions, permitted days of stay, and stamps or records of every entry and exit in the relevant period. | Do not equate the visa sticker’s validity with permitted days of stay, or treat a short trip abroad as a fresh allowance. |
| Residence permit and renewal | Permit expiry, the date of a valid timely renewal application, and the application document or other relevant official evidence. | An appointment booking or preliminary reference alone is not sufficient evidence of your legal position. |
| Work permit or exemption | Its validity, applicable renewal rules, any separate valid residence status and any relevant protection category. | Do not apply ordinary work-permit rules indiscriminately to protection-category permits, or overlook the renewal rules applicable to your case. |
| Refusal, cancellation or a departure period | The decision, its service date and any departure period or instructions given by the competent authority. | Do not borrow a deadline from someone else’s experience, or treat a flight booking date as a substitute for the decision’s date. |
Illustration: visa validity is not an allowance of days
Suppose a visa sticker is valid from 1 September to 30 November 2026, but its conditions allow a stay of 30 days. The holder enters on 10 September and is considering departure on 5 October. Earlier visits must also be included where the applicable rule requires them to be counted. The task is not to rely on 30 November. Collect the visa conditions and visit history, establish the days actually permitted for that case, and compare the proposed departure with that record. This illustration alone does not establish whether 5 October is lawful or an overstay, or determine a fine or entry ban: visa conditions, earlier visits and any other lawful basis can affect the answer.
Illustration: a card expires while a renewal application exists
Suppose a residence card expires on 30 September 2026 and its holder has an official document for a valid renewal application submitted on 10 September. The review should place the card’s expiry alongside the application date, official document, application status and any later decision. The card’s expiry alone is not the entire factual record. If the first application was instead made on 5 October after the card expired, the earlier period cannot automatically be described as lawful merely because an application now exists. The competent authority must assess the actual case; acceptance, erasure of a breach and a general grace period must not be assumed. An appointment booking is not automatically the same as an official residence application document.
These hypothetical examples show how to organise the dates; they do not calculate an individual overstay. If a stamp, record or decision conflicts with another document, identify the discrepancy and seek clarification rather than replacing the recorded facts with an estimate.
How much is the fine?
There is no reliable universal daily figure. The amount can depend on nationality, duration, age, applicable agreements, the permission breached and charges under Fees Law No. 492. Migration Management’s guidance directs people to the official border assessment for the final amount. Unofficial calculators may not match the recorded liability.Distinguish the overstay fine from residence application fees, the card charge, other public debts and removal costs. Paying one does not settle all the others.
Departure before detection with payment
The official published framework distinguishes voluntary departure before the breach is detected, with the required fines paid. For an overstay of less than three months, that framework provides no overstay entry ban where its conditions are met; other independent restrictions can still apply. At three months or more, the published bands are:- Three to six months of overstay: one-month ban.
- Six months to one year: three-month ban.
- One to two years: one-year ban.
- Two to three years: two-year ban.
- More than three years: five-year ban.
Other departure categories can have more serious effects
Different bands, ranging from three months to five years, apply in specified cases such as unpaid fines, failure to comply with a departure invitation, relevant departure following refusal/cancellation, escorted removal, applicable detention/alternative-measure cases or failure to apply for residence following conditional entry. Do not assume the more favourable voluntary-departure table applies simply because a ticket is booked or a fine is paid. Independent restrictions can add further consequences.
Checking and signing a contract
At the border
Before travelling, organise your passport, earlier residence or work documents, and any refusal, cancellation or departure decision. Check the departure instructions that apply to your case and allow sufficient time at the airport or land border for the official assessment. Ask the competent authority about the official payment point and accepted method; do not rely on a universal counter, bank or online-payment link described by an unofficial agent.- At the official assessment, check that the personal details and dates relate to you; ask for clarification if the records differ from your documents.
- Pay only through the competent official office or channel identified for your case, and obtain an official receipt. Do not give fine money to an unofficial agent.
- Keep the original receipt and a digital copy, with any assessment or reference supplied to you. Payment and an entry-ban decision are separate matters.
- If an entry-ban decision is issued, request a copy or the available official information. Retain any refusal, cancellation, departure or removal decision and its notification details.
- Ensure departure is correctly recorded. After travel, keep the exit record with the ticket and boarding pass; the travel booking alone is not proof of the recorded exit.
If the fine is unpaid
Non-payment can lead to an adverse entry-ban category, a continuing debt, visa or entry refusal, and a requirement to settle the debt before future admission. Expiry of a ban does not itself erase unpaid fines or other public liabilities.
Can a late residence application resolve the problem?
Certain short-delay applications may be considered under the official procedure, but this does not erase the breach, guarantee approval, create a general grace period or prevent removal on another ground. Apply before lawful stay ends and obtain guidance on an actual late case immediately.
Challenging an error
Obtain the official documents if the duration, dates, amount, payment, ban or identity is wrong. The remedy against a fine differs from a claim against an entry ban, and payment does not automatically remove the ban. Have a lawyer identify the correct authority and deadline from the actual decision.
Keep evidence
- Current and earlier passports, with the relevant entry and exit stamps or records.
- Previous residence and work cards, valid-renewal evidence and official residence application documents.
- Refusal or cancellation decisions, notification details and any document specifying a departure period.
- The financial assessment, official payment receipt, and any entry-ban or removal decision.
- Tickets and boarding passes, enquiry references and correspondence with Migration Management.
Keep the records in chronological order. If you dispute a date, payment or decision, retain both the document showing the disputed point and the evidence supporting your account; do not publish personal passport or case details in a public discussion.

Practical checklist
Identify the final lawful day and recorded presence, check any refusal/cancellation, seek procedural information from Migration Management or YİMER, use official payment channels, keep receipts and obtain a copy of any ban. Avoid assuming a border trip resets 90 days, waiting until expiry to renew, relying on unofficial fine estimates or treating payment as automatic cancellation of a restriction.

Records and checks
| Stage | Record | What to check | What to retain |
|---|---|---|---|
| Before travel | Passports and stamps, residence/work cards, application papers and decisions. | The sequence of entries and exits, the last lawful basis of stay, and any decision, service date or departure deadline. | Legible copies in chronological order, together with the originals required when approaching the competent authority. |
| Financial assessment and payment | An available assessment or breakdown and the official payment receipt. | The person or identifying details concerned, amount, payment date and reference, and what the assessment covers. | The original receipt, a digital copy and any official reference for a payment enquiry. |
| Recording departure | The exit stamp or record, travel documents, and any notified entry-ban or removal decision. | The recorded departure date and the decision’s grounds, duration and stated remedy; travel documents alone do not replace the official record. | Boarding pass and ticket, copies of decisions and the available departure record. |
| Later enquiry or challenge | The document showing the disputed point, with the receipt or decision, service date and earlier correspondence. | Is the dispute about dates, the charge, payment recording, an entry ban or removal? Each needs the appropriate procedure. | The enquiry and attachments, its reference or proof of submission, and replies. Identify any challenge deadline from the actual decision with qualified help. |
Practical questions before departure or return
Will a short trip abroad start a new allowance?
Do not rely on that. Assemble the earlier visit record and the visa or exemption conditions: a short exit does not reset the 90/180 rule. If stamps are unclear or the official record differs from your papers, seek confirmation of that record before using it to plan travel.I paid the fine. Is the entry-ban issue finished?
A receipt proves payment; it does not by itself prove that every ban or restriction has ended. Keep it and request available information or a copy of the decision, including its grounds and duration. Treat the payment question separately from whether you can be admitted again. What if I am told the payment is not recorded?
Start with the assessment and receipt. Check the person or identifying details, amount, date and reference, then ask the relevant official authority to verify the record. Supply a legible copy and retain the enquiry reference and reply. Do not assume that the debt has disappeared or that another payment is required before the record is clarified. Is a late residence application enough to regularise the earlier period?
No. The existence of an application does not erase a breach or guarantee acceptance. Present the actual dates and documents to Migration Management for procedural guidance. The possibility of assessment in certain late cases must not be treated as a general period of permission to remain without a lawful basis. What should I check before buying a ticket to return?
Check the entry requirements applicable to you, any entry-ban decision or independent restriction and its duration, and the status of recorded fines or debts. Expiry of a ban or issue of a visa does not in itself guarantee admission at the border. Do not base a non-refundable booking on a guess about the restriction.Which document determines the next step if I want to challenge something?
First identify the disputed issue: a financial charge, payment recording, an entry/exit date, an entry ban or removal. Gather the document showing the measure, its service date and the contrary evidence. The authority, procedure and deadline depend on the decision. If a decision affects your status or liberty, obtain prompt legal advice based on its actual wording.Official sources for reference
