Administrative Detention and Removal Centres in Türkiye in 2026: Rights, Reviews and Alternatives
Administrative detention (İdari Gözetim) can be imposed on certain foreign nationals subject to removal, with detention in a removal centre (Geri Gönderme Merkezi, GGM). It is a restriction of liberty rather than a criminal sentence and requires a reasoned decision, review and access to a judicial challenge.

Practical overview
| Decision | Review route |
|---|---|
| Administrative court within seven days | |
| Separate application to the criminal peace judge | |
| Review necessity and alternatives |
Two separate decisions and two remedies
A removal decision is challenged in the administrative court within seven days of service. An administrative detention decision is challenged before the criminal judge of peace (Sulh Ceza Hâkimi). Release does not necessarily cancel removal, and alternative obligations may continue. One application should not be assumed to challenge both decisions.
Statutory detention grounds
Relevant grounds under Law No. 6458 include risk of absconding, breaches of entry/exit rules, false documents, failure to leave within the permitted period without an acceptable excuse, and public order, security or health concerns. A removal decision alone does not mean detention is necessary; the legal grounds and individual circumstances must be assessed.
Removal centres and detention limits
Centres hold people under administrative detention pending removal, release, expiry of its necessity, substitution of alternatives or another legal end to the measure. Detention does not remove the right to challenge either decision.Removal-related detention is initially limited to six months. An extension of up to another six months is possible where removal cannot be completed because of non-cooperation or failure to supply correct identity/travel information or documents. The potential 12-month total is not an automatic entitlement to detain for that long; lawful grounds must continue.
Monthly review
The governorate must review continuing necessity monthly and may review sooner when circumstances change. A documented address, reduced absconding risk, inability to remove, medical/humanitarian circumstances, a court decision or an available alternative may be relevant. Detention must end when its lawful necessity no longer exists.
Reasons and notification
The detention decision, extensions and monthly review results must be notified with their reasons to the person, legal representative or lawyer. The person should be informed of the consequences and remedy, particularly if unrepresented. Ask for copies and record service dates.
Challenging detention
The person, representative or lawyer may apply directly to the competent criminal judge of peace or give the application to the centre administration, which must forward it promptly. The application does not itself suspend detention. The statute requires determination within five days, and the judge’s decision is final under that procedure. A new application is possible when detention conditions change or disappear. There is no reason to wait for the next monthly review before seeking release.
Seeking assistance with an application
Evidence relevant to release
Depending on the file, provide evidence of a stable address, family/children, employment or study and community ties, cooperation and delivery of identity/travel documents, lack of genuine absconding risk, medical needs, inability to remove within a reasonable time or a suitable less restrictive measure. Explain any inadequate reasons, missing monthly review or continued detention after its basis ended. General assertions should be supported by documents.
Alternatives
One or more statutory alternatives can include a designated address, reporting, family-based return arrangements, return counselling, voluntary public-benefit activities, a financial guarantee and electronic monitoring. Alternative obligations cannot exceed 24 months. Breaching imposed conditions can lead to detention again.Electronic monitoring can also be challenged before the criminal judge of peace. That challenge does not automatically suspend monitoring; the statute gives a five-day determination period and a final decision under that procedure.

Legal representation and assistance
A lawyer can handle the removal challenge, detention/release and monitoring applications and concerns about centre conditions. A person unable to afford fees may seek legal aid under the applicable Advocacy Law provisions, normally through the competent bar association’s procedure.
Rights in a centre
The legal framework includes necessary emergency/basic healthcare for those unable to pay, contact with relatives, access to a lawyer/legal representative and notary, consular contact, relevant UNHCR access and communication facilities under centre rules. Children’s best interests, suitable family/child arrangements and access to education through coordination with the education authorities must be considered. Document ill-treatment, denied medical care or obstruction of legal contact and inform the lawyer and competent bodies promptly.
Prepare the file
Keep detention and removal decisions, service evidence, identity/passport, previous residence/work documents, address certificate and tenancy contract, family/birth documents, employment/study records, medical reports, cooperation evidence and any relevant court decisions. Supply reliable contact details for someone able to receive the person or verify the address.
Immediate steps
Obtain both decisions, record their dates, contact a lawyer/bar association, preserve the seven-day removal deadline and make the separate detention challenge. Provide evidence for a suitable alternative, follow monthly reviews and comply with release/reporting conditions. Do not sign unread documents, conceal identity/address, assume release cancels removal or leave the lawyer unaware of the detention location.
