Statelessness in Türkiye: Recognition, Identity and Lawful Stay
If you have no nationality connection with any state, the required step differs from replacing a passport or renewing a residence card. It begins with determination by the competent authority, supported by evidence of the facts, and requires distinguishing the temporary application document from the stateless person identity document issued after determination.
This guide helps organise evidence, intake, the interview, follow-up, identity issuance and renewal, and the limits of work and travel. It does not decide your nationality or eligibility or turn missing documents or a lost passport into automatic recognition as stateless.
Information current as of 26 October 2026.

1) Who needs this procedure?
A stateless person has no nationality connection with any state. This procedure concerns requesting determination of that status by the Turkish authorities, followed by the document for someone recognised as stateless. Having no passport at present, or not knowing which authority can issue a document, does not by itself determine statelessness.
If there is also a fear of persecution or danger on return, explain it to the competent authority and seek assessment of the appropriate procedure. Statelessness determination, international or temporary protection and humanitarian residence are different procedures; do not abandon an existing file on the promise of a new identity document.
| Situation | What needs establishing | Important distinction |
|---|---|---|
| Lost or stolen passport | Reporting and replacement through the issuing authority, and residence status | Losing the document does not mean losing nationality |
| Expired or new passport | Document validity and updating migration records | A changed number is not statelessness determination |
| No nationality connection with any state according to the facts | Evidence of former nationality or its absence and competent assessment | A statement alone does not mean the final identity document has been issued |
| A stateless identity document or passport issued by another state | The document type and existing status before seeking a procedure in Türkiye | Specific exclusions apply; do not treat this as an ordinary new Turkish determination request |
2) The responsible authority and how to start
People who arrived in Türkiye stateless or lost their nationality while in Türkiye apply to the governorate for determination of their situation. Start with the Provincial Directorate of Migration Management to establish the intake location and file instructions, stating expressly that you seek statelessness determination, rather than simply residence renewal or a replacement passport.
Applications are normally made personally. A minor's mother or father may apply; if neither is available, an appointed guardian or curator may do so. The Regulation requires approaches made inside the country or at border gates to law-enforcement bodies or other public bodies to be reported immediately to the governorate. This does not make an ordinary message or appointment booking an official application document.
The central migration authority determines the status, and the governorate issues the identity document with the required approval. At intake, ask for the application reference, notification method, how to provide additional evidence and what to carry while waiting; do not assume this procedure has a universal option in the ordinary e-İkamet screen.
3) Organising the evidence file
The Regulation provides for requesting information and documents showing the absence of a nationality connection with any state. Prepare a clear sequence of events, available evidence and reasons why other material cannot be obtained. The following table is practical preparation for explaining the case, not a uniform mandatory national checklist or a requirement to purchase every translation and authentication service.
| What to organise | What it explains | Limit on its use |
|---|---|---|
| Current and former identity documents and passports, if available | Names, dates of birth and previously recorded nationalities | An expired document may be historical evidence without being valid for travel |
| A nationality-loss decision or relevant official correspondence | When and how the legal connection changed | Not every refusal to issue a passport proves loss of nationality |
| Information about possible nationalities and family connections | States relevant through birth, parents or former nationality | Identify every relevant connection, not only the state you choose |
| Entry evidence and residence or protection records, where available | Arrival history and existing files and decisions | Do not conceal another decision or assume this request cancels it |
| Previous statelessness requests in another state and their outcomes | What was requested and decided, including refusal reasons | Recognition or a status document from another state affects the Turkish procedure |
| A list of unavailable documents and the reasons | What you tried to obtain and what prevents producing it | Explain the obstacle to the authority rather than creating a false document, translation or answer |
4) If documents cannot be produced
The Regulation allows a reasonable period to produce evidence supporting the claim; it does not establish one fixed number of days for every file here. Where a person cannot produce any identity-related document, their statements may be relied upon. This permits assessment of the facts when documents are missing; it does not excuse inaccurate information or guarantee acceptance.
Where information and documents cannot be obtained personally, provisions of the relevant state's nationality law may be accepted as evidence. The central authority may also request information and documents from the state of former nationality. If there is suspicion of an unrecorded population-registration case, the authority contacts population and citizenship directorates for the necessary examination. Do not decide that a consulate's lack of response ends the nationality inquiry.
Before paying for translation or authentication, establish with the receiving authority the actual document, pages, language and procedure required. If contact with a particular state creates a risk, explain it to the competent authority and seek appropriate legal guidance; do not follow a generic correspondence checklist without considering an existing protection situation.
5) Following the application through to the identity document
The following steps combine the official procedure with practical file organisation. An inquiry and document preparation do not replace registering the application or issuing the application document.
- Identify the facts: former or possible nationalities, why you claim none remains, your present location, status and existing decisions.
- Contact the competent governorate office about intake and state that statelessness determination is requested. Establish arrangements for a child or appointed representative where applicable.
- Apply personally as required, with available evidence and an explanation of what cannot be produced. Keep the file reference and copies of submissions.
- When the application is accepted, verify issuance and details of the free application document valid until the decision, and what to carry with it. Do not substitute a message or appointment screenshot.
- Attend the notified interview and clearly explain the nationality, entry and livelihood history and any previous request in another state. Notify the authority promptly of a compelling obstacle affecting attendance.
- Provide requested additional evidence within the notified period, retain proof of submission and follow up with the unit handling the file using its reference.
- Establish the decision and how it will be notified. Following positive determination, arrange issuance of the individual identity document through the governorate and check the name, foreigner identity number, details and date.
- Keep the decision, identity document and renewal date, and separate any work, travel or other residence-category application. If the decision is negative or the document is cancelled, seek prompt legal assessment of the actual decision and its deadlines.
6) What does the interview cover?
Under the Regulation, the interview takes place no later than fifteen days after completion of application and registration, except for compelling reasons. Its report and the governorate's opinion are sent to the central authority for decision. Prepare for the following points without memorising a fabricated account or concealing a fact because you do not know the answer.
| Official point | Useful preparation | What to avoid |
|---|---|---|
| When and how you entered | Arrival sequence and available evidence | Inventing a stamp or a supposedly certain date |
| Relatives in Türkiye and their locations | Relationship details and known places of residence | Concealing a relative or giving a false address |
| How you support yourself | An accurate account of resources and assistance | Importing a tourist-residence income threshold |
| How you became stateless | Decisions, dates and events | Confusing loss of passport with loss of nationality |
| Former nationality and its evidence | Names, documents and former connections | Selecting one document while hiding contradictory evidence |
| Status requests in other states and any refusals | Application references, decisions and reasons | Treating an overseas request as irrelevant |
| Possibility of recovering former nationality | Available information and responses without guessing | Assuming recovery is impossible without explaining the basis |
7) Timing and follow-up during assessment
The Regulation provides for the central authority to complete determination of whether the person is stateless within ninety days at the latest, consulting relevant bodies where necessary. Separate this framework from the interview date and printing or collection of the identity document; do not turn it into a promise of a ready card on day ninety or a new visa period.
Keep the file reference and official document, and follow notification and missing-evidence instructions. If the interview is delayed or the outcome is unclear, ask the unit handling the file about its stage and what is required, recording the response and date. Silence does not imply approval, and creating another general application in a different system should not be assumed to accelerate the case.
8) The application document is not the final identity document
This is the key distinction when considering periods and rights. The application document is issued for an accepted application pending the decision; the stateless person identity document follows determination of the status. Acceptance of an application is not final recognition as stateless.
| Comparison | Application document | Stateless person identity document |
|---|---|---|
| Issuance stage | For an accepted application pending the decision | Following status determination and the competent issuance procedure |
| Period | Valid until the decision under the Regulation | Renewed every two years while statelessness continues |
| Counting stay | Lawful stay on this document does not count towards the total residence-permit period | Time in Türkiye holding this identity document counts when residence periods are aggregated under the Law |
| Charge and effect | A free document; it does not mean the final identity document or work and travel authorisation has been issued | A fee-free identity document substituting for a residence permit and containing a foreigner identity number; other rights have their own limits |
9) Rights attached to the identity document and their limits
The Law regulates rights and safeguards attached to the final identity document. A foreigner identity number does not mean every transaction is automatic or that work, travel and healthcare requirements disappear.
| Issue | What the legal framework establishes | What does not follow automatically |
|---|---|---|
| Stay | The identity document provides lawful residence and substitutes for a residence permit | Turkish citizenship or a permanent document needing no renewal |
| Another residence category | An application may be made where its conditions are met | Tourist, family or long-term approval without assessing its conditions |
| Removal | Protection from removal unless there is a serious public-order or public-security threat under the provision | Absolute immunity or automatic cancellation of every existing decision |
| Reciprocity | Exemption from the reciprocity condition required in foreigner-related transactions | Exemption from every condition and charge in every service |
| Work | The applicable work-permit legislation and procedures govern employment | The identity document itself being a work permit or blanket exemption |
| Travel document | Access to a passport for foreigners within Article 18 of the Passport Law framework | The identity document being a passport, or automatic admission or return accepted by every state or airline |
If you intend to work, establish the procedure with the employer and competent authority before starting. If you intend to travel, confirm the travel document, destination and transit acceptance and return documents before buying a ticket. Do not import travel rules for an ordinary residence-application document merely because the name sounds similar.
For healthcare, social assistance or a banking transaction, check registration, eligibility and the relevant institution's requirements for your actual status. This guide does not make the identity document a guarantee of a free service or replace confirmation of existing health cover.
10) Charges and costs
The application document and stateless person identity document are fee-free under their specific provisions. Do not automatically apply an ordinary residence-card charge or lost-card replacement tariff to them. Ask for the legal basis of a requested amount and the official receipt before payment.
Your file may involve separate services actually needed, such as translating a particular document or obtaining a copy, or different work and travel procedures. The exemption does not establish that all such services are free. This guide gives no uniform translation tariff or suggestion that an intermediary can purchase recognition of the status.
11) Renewal and the end of validity
The governorate renews the identity document every two years while statelessness continues. Keep its date and contact the authority in advance about renewal arrangements and what is needed to establish continuation of the situation. Two years is not an automatic period of stay after document expiry, and booking an appointment does not complete renewal.
The identity document loses validity upon acquiring the nationality of any state. The Regulation also provides for cancellation where false information or documents are discovered in the application, or a removal decision is made because of a serious public-order or public-security threat. Report the changed situation and arrange the appropriate documents and status; do not continue using an invalid identity document.
12) Situations needing particular follow-up
If you hold a stateless identity document or passport from another state, disclose it at the outset. Holders' applications are not processed as new Turkish determination applications under the stated exclusion. A holder of a foreign stateless identity document seeking Turkish residence is dealt with under general provisions and must hold a passport or valid substitute; this does not mean automatic approval of a particular residence category.
If there is a refusal, cancellation, removal decision or another status close to expiry, separate each decision, date and effect. Keep the notification and obtain prompt legal assessment; do not borrow an appeal deadline from a tourist-residence or consular-visa file, or assume that an inquiry or reconsideration message suspends every procedure.
Protect the file's personal data. Submit nationality records, addresses and identity numbers through the required official channels rather than a public comment. A general question can be shared without document images or relatives' information exposing other people.
13) Two examples of choosing the right next step
Example one: a resident holds a state's nationality and loses their passport while the residence permit remains valid. They start reporting and replacement, update migration records when the passport changes, and establish documents to carry and travel requirements. Loss of the passport does not make them stateless or justify claiming nationality has ended.
Example two: a person has documents indicating loss of former nationality and, on the facts presented, no other nationality connection. They organise the evidence, possible nationalities and earlier correspondence, and apply to the competent authority for determination. Once the application is accepted, they carry its official document pending the decision; they do not count that document's period as if it were time holding the final identity document. If the status is determined and the identity document issued, they arrange renewal and assess work and travel separately. The example explains file organisation without deciding eligibility or outcome.
Frequently asked questions
Does losing a passport make me stateless?
No. Nationality is a legal connection; a passport is a document. Begin the document procedure with its issuing authority rather than claiming statelessness merely because it is lost.
Is my consulate's refusal to issue a passport sufficient?
Not on its own. Organise the reason, records and relevant connections for competent assessment rather than equating a document problem with the absence of every nationality.
Where do I start?
With the governorate and competent migration directorate to establish intake arrangements and instructions for a statelessness application. Do not assume it is ordinary residence renewal.
Must I apply personally?
Normally yes. For a minor, a parent may apply; if neither is available, an appointed guardian or curator may do so under the Regulation.
Must I have every document before approaching the authority?
Organise what is available and explain the obstacle. The Regulation allows reasonable time for evidence and may rely on statements when no identity document can be produced; this does not guarantee recognition.
What evidence can be used if nationality records cannot be obtained?
The relevant state's nationality-law provisions may be accepted where information and documents cannot be obtained personally. The authority assesses the material and may request information from the state of former nationality.
When is the interview?
Under the Regulation, no later than 15 days after completion of application and registration, except for compelling reasons. Follow the notification rather than counting from a general inquiry.
How long does determination take?
The Regulation states a maximum of 90 days for determining whether the person is stateless. This is not a guarantee of a ready card on a particular date or a new visa.
What should I carry while waiting?
Verify issuance of the official free application document for an accepted application, valid until the decision, and what the authority requires alongside it. An appointment or message does not replace it.
Does time on the application document count towards total residence?
No. The Regulation distinguishes stay based on the application document from time holding the final identity document. The latter counts under Article 50 of the Law.
Is the identity document residence permission or citizenship?
It substitutes for a residence permit and provides lawful stay under the provision, with a foreigner identity number. It does not grant Turkish citizenship.
Are the application document and identity document charged?
Their specific provisions make them fee-free. Do not automatically apply an ordinary residence-card tariff, and separate other services actually needed.
When is the identity document renewed?
Every two years through the governorate while statelessness continues. Establish instructions in advance rather than assuming a general post-expiry grace period.
Can I work with the identity document alone?
Do not treat it as a work permit. Employment procedures are governed by the relevant legislation; establish the applicable permit or procedure before starting work.
Can I travel with the identity document alone?
Do not assume it is a passport. The framework provides access to a travel document for foreigners under the Passport Law; destination, transit and return requirements require separate confirmation.
I hold a stateless identity document from another state. Should I repeat determination?
Disclose it at the outset: the exclusion for holders of another state's stateless identity document or passport prevents processing as an ordinary Turkish determination request. Another residence application follows its general provisions and required travel document.
What happens if I acquire a nationality?
The identity document loses validity. Report the change and arrange your documents and new status rather than continuing to use an invalid identity document.
Does this guide specify an appeal deadline for refusal or cancellation?
It does not establish one universal deadline. Keep the decision and notification and seek prompt legal assessment; do not import another residence category's deadline or assume an inquiry suspends implementation.
