🚫 Removal and Entry Bans in Türkiye 2026: Decisions and Legal Remedies

1) Two different decisions
  • Removal or deportation: a decision requiring a foreign national to leave Türkiye on a statutory ground.
  • Entry ban: a restriction on entering Türkiye, which may arise alongside removal or another immigration issue.
Administrative detention is a third, separate decision. Challenging one does not automatically challenge all the others.

2) What can lead to a removal assessment?
The law identifies grounds including specified visa or residence breaches, cancelled permits, unauthorised work, false documents or information in immigration procedures, and qualifying public-order or security grounds. The precise statutory conditions matter. An ordinary unpaid debt, a routine civil dispute or merely receiving a court notice is not by itself a universal removal ground.
Removal is also subject to protections, including non-refoulement and the individual exceptions in the law. Serious return risks, health circumstances or vulnerability should be raised promptly with evidence.

3) What to do immediately
  1. Obtain copies of the written decision, reasons and service record.
  2. Note when and how it was served, and which authority issued it.
  3. Do not rely only on a verbal explanation or an unexplained restriction code.
  4. Contact a lawyer experienced in migration law promptly.
  5. Request interpretation and do not sign a document you do not understand, especially a purported voluntary-return statement.

4) Is a challenge possible?
The removal decision has a special, short court-filing period: seven days from service under Article 53(3). The Constitutional Court's decision E.2020/30, K.2023/12 addresses the rule. Obtain advice immediately about the competent administrative court, notification to the issuing authority and the protection available while the challenge is pending.
An entry-ban challenge and a challenge to detention follow their own rules. Do not use the removal deadline as a universal deadline for every immigration decision, and do not assume an informal administrative complaint is a court case.

5) Reducing preventable problems
Keep your permission to stay valid, apply for renewal within the permitted window, work only with the required authorisation, maintain an accurate registered address and respond appropriately to official notices. Resolve financial disputes through documented lawful arrangements, without confusing a civil disagreement with an immigration breach.

6) When should you avoid handling it alone?
Seek prompt help if there is a criminal investigation, detention, a written decision with a short deadline, a disputed restriction code, or refusal of entry at the border. The duration and removal of a ban depend on its actual basis; a generic code list cannot determine every case.

Practical takeaway
Get the written decisions, establish their service dates and use the correct remedy for each. Act quickly and support any legal or protection claim with evidence.
