Humanitarian Residence in Türkiye: Circumstances, Evidence and the Responsible Authority

Humanitarian residence is an exceptional route assessed by the competent authorities under circumstances defined in law. The practical starting point is to identify the facts, existing decisions and office responsible for your file, then provide relevant evidence and follow the decision and its conditions. Calling a request humanitarian does not establish eligibility or change legal status by itself.

This guide explains organising a request for assessment, evidence and follow-up under Articles 46 and 47, separately from medical treatment, international protection and challenges to residence or removal decisions. It does not determine an individual's eligibility or make illness, irregular stay or a lost passport automatic grounds for a permit.

1) Understand the basis and limits of humanitarian residence

The law allows humanitarian residence to be granted and renewed in specified circumstances without requiring the conditions attached to other residence types, within periods determined by the Ministry and with the required central approval, with issuance by the governorate. This does not mean an evidence-free or assessment-free application, or that everyone unable to meet another category's conditions qualifies.

Describe the actual situation: what prevents departure or makes it unreasonable, or what child's interests or circumstances require assessment? Connect that description to documents, decisions and dates rather than copying another person's successful case under different circumstances.

2) Statutory circumstances that may require assessment

Article 46 identifies several circumstances. The table helps organise what to explain to the authority; an apparent resemblance to a phrase does not determine applicability or the outcome.

Statutory circumstanceWhat the file needs to explainPractical limit
The child's best interestsCare, relationships and facts affecting the individual childHaving a child alone does not automatically grant residence to the whole family
Removal cannot be carried out, or departure is unreasonable or impossible despite a removal decision or entry banThe decision, actual obstacle and supporting evidenceA humanitarian request does not itself cancel the other decision
No removal decision under Article 55Individual circumstances assessed by the authority and supporting documentsNot every illness or travel difficulty is an established case under the provision
Court action against procedures under Articles 53,72 or77The decision, challenge, reference and current positionA humanitarian request does not replace proceedings or automatically preserve every deadline
Continuing arrangements for sending an applicant to a first country of asylum or safe third countryProcedural documents, responsible body and stageA defined procedural situation, not every journey to a third country
Entry and stay for urgent reasons, national interests or public order/security where another residence type is unavailable within the statutory frameworkThe facts requiring assessment and how the legal conditions fit togetherNot a shorthand for every urgent personal need
Extraordinary circumstancesThe event, effects, evidence and action already takenThe authority assesses the case; a list of others' experiences cannot guarantee approval

3) Distinguish treatment, protection and legal challenges

Planned treatment has its own residence route and medical/financial evidence. Serious health circumstances, travel risks or unavailable treatment on return may raise different statutory questions, but a hospital booking or diagnosis does not automatically grant humanitarian residence. Medical professionals describe medical facts; the competent authority decides their immigration consequences.

International protection, temporary protection and humanitarian residence are different systems and statuses. If the issue is fear of return, persecution or safety risk, explain it clearly and obtain assessment through the appropriate route. Do not withdraw a protection file or abandon a procedure merely because someone promises a humanitarian card.

Residence refusal, removal, an entry ban or detention may require separate urgent action. Keep every decision and notification and seek prompt legal assessment of the deadlines and effects of each procedure. A humanitarian request or letter to the Directorate is not by itself evidence that every decision is suspended or lawful stay extended.

IssueWhat to organise firstWhat not to assume
Treatment or inability to travelAppropriate medical evidence of the condition, period and actual restrictionsEvery patient qualifies, or a report itself grants travel or residence permission
Fear of return or protection proceedingsFacts, references and decisions for the competent body and legal assistanceHumanitarian residence automatically replaces every protection route
Residence refusal, removal or entry banThe decision, service date and its specific legal routeA humanitarian request replaces an objection or court case
Lost passport or overstayingAvailable identity evidence, the event, status and procedural optionsLoss or irregular stay creates an independent right to humanitarian residence

4) The responsible authority: identify your file with the Directorate

Contact Migration Management in your province to establish the office responsible for your file and how to present a humanitarian residence assessment request. Grant and renewal involve governorate competence and the statutory approvals; a hospital, association or private service office does not issue them.

Explain current status, previous decisions and the reason for requesting assessment, and confirm intake arrangements, evidence and attendance or representation for your case. Do not select another online category merely because it is available, or assume that a general form or a file submitted for another type establishes a humanitarian application.

If a lawyer or legal representative assists, clarify their authority and communication arrangements and check what attendance or signature remains necessary from you. Family relationship or an association's help does not automatically establish legal representation for every procedure. Obtain a reference showing what the authority actually received.

5) Prepare a concise explanation and timeline

Write an accurate statement identifying yourself, your status, the request for assessment and principal facts. Separate direct knowledge from information relayed to you and identify evidence for each point. Do not merely say travel is impossible without explaining why and what supports that statement.

Put entry, permits, decisions, notifications and health, family or procedural changes in chronological order. If a document is unavailable, explain what it is, why it cannot be obtained and what alternative exists, asking the authority what it accepts. Do not enter false details to fill a field or amend a document yourself.

  1. Collect identity/file references, current decisions and evidence of service dates.
  2. Identify the circumstances and actual effects to be assessed without deciding eligibility yourself.
  3. Organise events and attachments chronologically, separating each family member's information.
  4. Identify changed and continuing facts, missing documents and why they are unavailable.
  5. Present the explanation and evidence through the Directorate-confirmed channel and keep a copy and receipt reference.

6) A case-specific evidence matrix, not a universal checklist

The following table helps organise potentially relevant evidence; it does not require every applicant to collect every item. Confirm requirements and any originals, copies, translation or certification with the Directorate according to the facts. Not requiring other residence types' conditions does not prevent the authority requesting information needed to understand and verify identity and circumstances.

Evidence topicPotentially useful examplesWhat to review
Identity and current statusAvailable passport, identity or residence documents and migration referencesNames, dates, discrepancies and missing or unobtainable documents
Existing decision or procedureDecision, notification, challenge references and administrative/judicial fileDecision type, issuer, receipt date and current status
Relevant health circumstancesMedical authority's evidence of restrictions, duration and requested factsCorrect person and dates; medical opinion is not an immigration decision
Child's interests or careRelationship, care and custody evidence where relevant, and facts about the childAdult's legal authority and the individual child's circumstances
Obstacle or exceptional eventCompetent body's documents, correspondence and evidence of the obstacle and attempts to address itConnection, duration and source without assuming applicability to every case
Address and contactActual address, contact details and evidence requested by the authorityAbility to reach you, consistent information and protection of sensitive data

7) Submission, interviews and additional evidence

Follow the intake channel and appointment confirmed for your request. Distinguish an enquiry, contact appointment or copy given to a support organisation from a request recorded by the competent authority. Keep a reference, a record of material submitted and subsequent requests.

If attendance or further explanation is requested, attend or make an official arrangement for any obstacle, asking for interpretation or clarification where necessary. Read what you sign, particularly anything concerning return, withdrawal or changing another file's status. A delayed reply or acceptance of attachments does not mean residence approval.

Record each notified deadline, response method and source, and provide evidence in the required format. This guide sets no uniform completion or assessment period for every humanitarian case. Correspondence alone does not establish a document allowing stay while assessment is pending; confirm your status and the applicable document explicitly.

8) Duration, decision and address obligations

The statutory wording links grant and renewal to periods determined by the Ministry. Do not treat one year as a fixed mandatory duration for every application. Read the decision and document issued in your case: type, start/end dates and any condition or review connected to the circumstances.

Humanitarian permit holders must register in the address system within 20 working days of issuance. Do not assume that writing an address on a paper or waiting for card delivery completes this obligation or changes its starting point. Confirm the registration procedure, responsible office and evidence of completion.

Follow any reporting condition, specified address or review requirement in your file and keep its details. If your address or contact information changes, coordinate updates with the relevant office. Remaining reachable matters for receiving requests and decisions.

9) Charges, healthcare and work

Not requiring other residence types' grant conditions does not make every service free or erase every previous financial obligation. Ask which charges, document fee or exemption applies to your case, and confirm the authority, payment channel and receipt. Do not pay merely for a promise of guaranteed approval.

A residence card is not an undertaking to provide free treatment or cover every family expense. Establish applicable healthcare entitlement, insurance or assistance with the responsible body, separately from the residence assessment.

Humanitarian residence does not give every holder unrestricted permission to work. An exemption category concerns humanitarian-status foreigners notified by the Interior Ministry within the specified scope and period, with the exemption information document used together with residence evidence under its conditions. Do not assume inclusion from holding a card alone. Establish the appropriate work permission or exemption and document before working, including the effect of changes or expiry.

10) Explain each family member's and child's circumstances

The child's best interests are an important statutory circumstance but require the individual facts and effects on that child. A family photograph or enrolment certificate does not establish that everyone qualifies for the same permit and period. Explain relationships, care, representation and each person's decisions and documents.

If a family member holds another valid status, do not assume it must be cancelled or automatically transferred. Discuss the humanitarian file's implications and each person's position with the competent body. If a parent is absent or custody or child protection is in issue, provide the actual facts and relevant documents rather than assuming an accompanying adult has full authority to represent the child.

11) Continuing circumstances, renewal and transfer

Arrange follow-up before document expiry and ask the Directorate about the procedure and timing for continuing circumstances. Update reports, decisions and facts instead of resubmitting an old file that does not explain the present position. Neither automatic renewal nor the same duration as the previous permit should be assumed.

Under Article 47, humanitarian residence is cancelled or not renewed through the statutory approval chain when the compelling circumstances cease. Report relevant changes and establish your position and next step. Do not continue using an old reason for a different purpose without review.

While the permit remains valid, its holder may apply for another residence type whose conditions are met, except long-term residence under the applicable transfer rule. Humanitarian periods are also not added to aggregated residence periods calculated under the Law. Do not turn this into a ruling on citizenship or every future procedure; check the specific requirements of the intended route.

Another residence basis emergesEvidence and conditions of the new purpose and current valid statusPossible transfer and its procedure, without assuming approval
Refusal, cancellation or non-renewalDecision, notification and file referencesRemedy, deadline and legal position with the authority and qualified assistance

12) Travel, adverse decisions and legal assistance

Before leaving Türkiye or planning a return, check passport or travel documents, permit status, any separate decision or restriction, and case-specific permission or documentation. A humanitarian card or request paper does not guarantee admission to another country or return to Türkiye in every situation.

If refused, cancelled or not renewed, retain the full decision and service date and obtain prompt assessment of the procedure, deadline and effect on stay. Do not transfer removal/protection appeal periods or effects to another decision without examining it, or treat an enquiry as court proceedings.

Where return risk, detention, a child's situation or difficulty understanding documents is involved, seek appropriate legal assistance and interpretation early, explaining missing information. An association or support body may help organise the file but cannot issue the permit or guarantee the authority's decision.

13) Two practical approaches without deciding eligibility

Example one: a person has medical evidence affecting travel, while current status and decisions require review. They collect a report explaining restrictions and duration, migration decisions and notification evidence, then ask the authority and legal adviser to assess treatment, non-removal or humanitarian routes according to the facts. They do not treat the report as residence permission or automatic suspension of another decision.

Example two: a family requests a child's best-interests assessment following a significant care-related change. They organise relationship, custody, current-status and child-specific evidence, explaining each adult's and child's position. They confirm intake, representation and follow-up of existing files rather than withdrawing another status or assuming one person's grant covers everyone. These examples organise evidence; they do not establish that the people qualify for humanitarian residence.

Frequently asked questions

Does humanitarian residence resolve every overstay?
No. It concerns statutory circumstances and individual assessment. Irregular stay alone creates no entitlement, and a request does not erase every previous consequence or decision.

Is illness or a lost passport enough?
Not automatically. Explain the facts, evidence and legal position and establish the appropriate route with the authority. The humanitarian label does not replace assessment.

Is it always valid for one year?
Do not generalise a fixed period. The wording links duration to periods determined by the Ministry; follow the decision and document issued in your case.

Who grants it?
The governorate grants it through the required approvals. Start with Migration Management to establish the office and intake channel for your file; private bodies do not issue it.

Should I select any online category to send my request?
Do not enter a category that misrepresents the request. Confirm the channel, form, evidence and attendance with the Directorate. Another category's file is not automatically a humanitarian application.

Is there one document list for everyone?
Evidence depends on the circumstances and authority's requests. Organise identity, decisions and relevant facts, confirming requirements and format rather than collecting inapplicable papers.

What if a document cannot be obtained?
Explain the document, the obstacle and available alternatives, and ask what is officially acceptable. Do not invent details or alter documents yourself.

Does waiver of other permit conditions mean approval without evidence?
No. Identity, facts, legal circumstances and the competent decision still require assessment, with obligations applicable to the file.

Does the request stop removal or deadlines?
Do not assume that from the request alone. Each decision and challenge has effects and deadlines requiring prompt assessment; humanitarian residence is not a substitute for the applicable legal route.

Is it international protection?
It is not the same status. Explain return risks and protection proceedings clearly and do not withdraw an existing procedure because someone promises humanitarian residence.

Does the whole family receive it together?
Do not assume so. Explain each person's status, representation, evidence and any other valid position. One decision does not automatically grant everyone the same type or period.

Does having a child guarantee family approval?
No. The child's best interests are assessed from the individual facts and do not replace evidence or each person's assessment.

When must the address be registered after a grant?
Within 20 working days of humanitarian permit issuance. Confirm registration and evidence of completion; writing an address on the request alone does not complete it.

Does the card mean free treatment?
Do not generalise that. Check applicable healthcare entitlement, cover and assistance separately from residence grant.

Does every humanitarian permit allow work?
Not automatically. Confirm applicable work permission or exemption and its document. The Interior-notification category applies to those notified within its scope and period, not every card holder.

Is renewal automatic while I have a card?
No. Follow up before expiry, update evidence of continuing circumstances and follow the Directorate's procedure. The reason ending affects cancellation or non-renewal under the Law.

Can I transfer to long-term residence?
The humanitarian rule does not allow that transfer, and its periods are not added to residence calculations under the Law. Other types require their conditions and procedure while your status remains valid.

Can I travel and return with the card alone?
Check passport, travel, entry, restrictions and case-specific documents with the competent authority. A card or request paper alone does not guarantee return.

What if the request is refused or the permit cancelled?
Keep the decision, notification and dates and obtain assessment of the route, deadline and effect on stay. Do not replace that with waiting for an intermediary or submitting another random request.

How do I seek help without publishing personal documents?
Give the responsible authority or qualified support a concise account of the circumstances, status, decisions and dates, retaining full copies through a secure channel. Do not publicly post diagnoses, passports or children's information.
