Residence Based on a Judicial or Administrative Request or Decision in Türkiye: Documents and Steps

A competent judicial or administrative authority may need a foreign national to remain in Türkiye, and the law includes this basis among short-term residence purposes. A case, witness status or objection receipt does not automatically establish the route. Start with the authority’s document requesting or deciding that the person must remain and specifying the period, then separately assess the residence application and conditions.

This guide organises the document, period, identity file, accommodation, cover, resources, application, follow-up and changing need. Selected sources were reviewed on 26 October 2026. It is not another guide to challenging a residence refusal or conducting court proceedings. Filing periods, stays of execution and the effects of an actual decision belong to their own procedures and documents.

1. A competent authority’s need for your presence, not merely a case file

The purpose covers people who must remain in Türkiye based on a judicial or administrative authority’s request or decision. Establishing the need does not mean that the issuing institution granted a residence card or automatically waived general immigration conditions. The foreign national submits the application and evidence under the actual status and stage.

Distinguish having a hearing, complaint or role in proceedings from an authority document stating that your presence is necessary and specifying the period. We declare neither every party nor every witness eligible, nor every paper bearing a court name sufficient. Ask the competent authority to clarify the required document if necessity or duration is unclear.

Do not manufacture a judicial basis for residence or conceal a refusal, entry ban or another relevant decision. This route requires a genuine basis and conditions; a complete file does not guarantee acceptance.

What you haveWhat to examineWhat not to assume
Case number, hearing or complaintWhether a request or decision states the necessity to remainThat the case alone creates residence
Request or decision requiring presenceAuthority, document, period and application conditionsThat the letter itself is a card or immigration approval
Objection to residence refusalNotice, procedure and any actual court decisionThat an objection automatically suspends every consequence
Another existing residenceIts basis, validity and relationship to the circumstancesThat proceedings automatically cancel or convert it

2. Requests and decisions: four checklist situations

The short-term checklist distinguishes an administrative request, administrative decision, judicial request and judicial decision. All four require a competent-authority document stating that the foreign national must remain in Türkiye and specifying the period within the statutory limits.

These are not four alternatives to choose simply by preference. Use the actual circumstances and what a competent authority issued; do not rename a request as a decision or a lawyer’s letter as a judicial order. Representation does not make the representative’s correspondence equivalent to the required authority document.

The next checklist category concerns transfer from family to short-term residence. Divorce or sponsor-death papers belonging to that category do not become this route’s document list merely because they appear immediately afterwards.

Actual situationDocument sourceShared required content
Administrative requestCompetent administrative authorityNecessity for the person to remain and a specified period
Administrative decisionAdministrative decision-makerNecessity to remain and a defined period
Judicial requestCompetent judicial authorityNeed for the foreigner’s presence and the requested period
Judicial decisionJudicial decision-makerNecessity to remain and duration within statutory limits

3. Checking the document before adding it to the application

The checklist specifies an electronically signed or signed and sealed/stamped document in the stated form. Check issuer, identity, connection to the reference, necessity to remain and the period. These are organisational checks, not authority to amend an order, replace a signature or create an unstated duration.

If you have only an appointment paper or a document without a clear period, show it to the issuer and Migration Management to establish what is needed. Do not assume the hearing date alone is the residence period or that an incomplete copy suffices. Retain the pages needed to understand the document and evidence of issue and delivery.

We impose no universal notary or apostille requirement on every Turkish authority document, and do not declare that any foreign judgment creates this residence purpose in Türkiye. Where issuer, language or copy format differs, ask the receiving authority about accepted evidence and case-specific authentication or translation.

ElementWhat to checkIf unclear
SourceCompetent issuer and request or decision referenceAsk the source for clarification rather than assuming competence
Applicant identityName and necessary details matching the applicationHave differences corrected officially; do not edit the paper
Necessity to remainWording showing that the person must remain in TürkiyeA case number or lawyer’s message alone is no substitute
DurationSpecified period within statutory limitsDo not select a duration from a hearing date alone
FormRequired signature, seal or electronic signature and accepted copyVerify requirements before paying for certification

4. Period of need, residence duration and your different dates

The authority’s specified period supports the purpose; it does not promise an identical residence grant. The law sets a general short-term ceiling of up to two years per grant within this scope. Documents, passport, cover, application and assessment still matter. Do not give every file two years or reintroduce a one-year cap from an old text.

Separate the authority letter’s issue date, beginning and end of the need, current permission expiry and requested residence duration. If a longer stay is needed or the period changes, obtain updated evidence and establish the applicable procedure before assuming the card is extended.

Check travel-document validity. The general residence-application rule is a passport or substitute valid for at least 60 days beyond the requested period, subject to applicable exceptions. An authority letter does not itself extend a passport or existing residence.

5. First application, transfer or renewal?

Identify actual status: visa, exemption, residence, pending application, refusal or cancellation. Show dates and documents to the competent authority to establish the correct stage. Do not create a new application simply because a letter exists without understanding the previous status’s effects.

Residence applications begin through official e-İkamet under the appropriate category and procedure and the form’s appointment instructions. Specified later transactions may use Göç Randevu, but it is no general replacement for a residence application. This guide does not claim proceedings create an entry exemption or automatically regularise every unlawful status.

Renewal opens during the 60 days before expiry and must be submitted before expiry, with continuing basis and conditions. That is no grace period after a visit ends. If an existing basis changes or a decision affects your stay, do not wait for the court appointment before checking immigration status.

6. Applicant documents are separate from the authority document

The common checklist includes a correctly signed residence form under the foreigner’s, legal representative’s or authorised lawyer’s capacity, passport or substitute-document identity, photograph and visa-page copies where applicable, and the original on appointment day. A case document does not replace applicant identity, proper signature or required representation.

The checklist specifies two white-background ICAO biometric photographs taken within six months. Organise references, application copies, payment evidence and any additional items, including a criminal record if requested under the conditions. We require no criminal-record certificate from every litigant or identical authentication for all papers.

7. Accommodation, resources, cover and notifications

The file requires applicable accommodation evidence and address details, with a document or declaration of sufficient and regular means throughout the stay under the checklist. Proceedings do not automatically make the state or issuing institution responsible for housing or expenses. We do not transfer family or tourist income formulas to this purpose.

Accepted health cover must cover the intended period under your circumstances. Checklist alternatives include entitlement, agreement and social-security documents, a general-health-insurance application or a private policy. Check the applicable alternative rather than automatically buying a new policy or assuming exemption because an authority requested your presence.

Extensions and transfers involve address registration, a current residence document and the required supporting evidence, plus UETS under the checklist with the under-18 exception. First-application address registration must be completed within 20 working days after approval. Correct phone and email details and monitoring alerts remain necessary.

GroupWhat to prepareImportant limit
AccommodationApplicable ownership, tenancy, hotel or hosting evidenceDo not collect all alternatives or use a fictitious address
AddressRegistration, document and bill or subscription where requestedA mailing address alone does not prove registration
ResourcesSource, sufficiency, regularity and requested evidenceProceedings imply neither funding nor one income threshold
HealthAccepted period of cover and appropriate documentNo blanket insurance exemption from this description
NotificationsUETS where applicable, phone, email and referencesAn appointment or message to a lawyer does not replace monitoring your file

8. Steps from the authority document to follow-up

Organise two connected processes: the issuer establishes the need to remain, and Migration Management assesses residence. Receiving one institution’s paper does not complete the other’s procedure.

  1. Identify lawful status, dates and the actual reason presence is needed; do not treat a case alone as permission.
  2. Review the competent authority’s request or decision for necessity, period, form and identity.
  3. Ask the issuer for clarification or a correct document if content is missing; do not amend it yourself.
  4. Prepare identity, photos, resources, accommodation and cover, plus stage-specific address and UETS requirements.
  5. Select the correct e-İkamet procedure and retain the form, reference and required office and appointment instructions.
  6. Match applicable charges and exemptions, pay required official items and keep receipts.
  7. Submit the file and required originals, follow any missing-item notice and deadline and keep delivery evidence.
  8. Monitor the decision, document and changes in need with the issuer and Migration Management, checking the next procedure before permission expires.

9. Fees and services: no assumed financial exemption

The residence-document charge for 2026 is TRY 964 per document, separate from residence harç. It is neither the total file cost nor an established 2027 tariff. Fees and exemptions depend on nationality, duration, category and assessment; a case or authority request establishes no exemption from every item.

The checklist mentions a single-entry visa fee in specified cases with exceptions, so do not add it to everyone’s file. Separate translation, representation, copy, cover and accommodation costs, and request a clear service scope and receipt. The official appointment is free; professional charges neither buy approval nor extend stay.

ItemWhat to verifyWhat not to assume
Document and residence charges2026 document fee, assessment and applicable exemptionThat TRY 964 is the total or the next year’s price
Single entry where applicableCase, exception and assessmentThat every person with proceedings owes it
Translation, representation and copiesActual service, documents, language and receiptThat any lawyer’s receipt establishes residence
Health and accommodationCover, genuine arrangements and payerThat the issuer pays every expense

10. Submission, missing items and assessment

Retain the document, application, appointment record, payment and delivery proof and notices. Handing a file to a representative or intermediary does not prove complete submission to the administration. If an original or certified copy is requested, establish delivery and return arrangements where relevant.

Guidance describes a 90-day residence-assessment period starting when complete information and documents reach the competent authority, with notification if it is extended. It is not measured from registering proceedings or opening the form and is no guaranteed card-delivery date.

For missing items, follow the notice’s deadline and channel and retain response evidence. We give no universal 30-day allowance or automatic extension while awaiting a judicial authority. If the document is unavailable, explain why before the deadline and seek instructions rather than fill the gap with inadequate evidence.

11. Changes in need or duration: follow up with both authorities

The requested period may change, the need may end, or a new document may be issued. Record the event and date, obtain evidence of the new position and ask Migration Management about its effect and the required procedure. A changed hearing or ended case automatically guarantees neither cancellation nor continuation of every immigration status.

If presence is still required, check updated evidence and the applicable renewal or application before permission expires. An old letter is insufficient to explain an entirely changed purpose, and a new letter does not extend the card by itself.

The selected sources establish no uniform notification deadline specific to this change that we apply to everyone. Follow up as soon as you learn of it and respect actual documentary or procedural deadlines. Do not substitute a period borrowed from address, passport or another category’s changes.

12. Decision, card, travel and work

Check the official result, category, name, dates and any conditions or duties once issued. Applying under this purpose does not mean the basis is accepted or a card has been issued. The card also provides no work right independently of the applicable labour route.

Before travel, distinguish the authority’s requirement to remain from residence evidence or an approved application document and its conditions. We do not declare a court letter or claim receipt permission to leave and return. Check actual case restrictions or duties with the competent authority too; a residence card does not itself remove them.

If refused, cancelled or not renewed, read the grounds, notification, rights, duties and applicable deadlines. Use the specialist refusal or court guide rather than a merely formal new purpose to bypass the decision. Conditions ending or use outside the granted purpose can affect continuation under the law.

13. The residence basis and challenging a decision

Filing a claim or objection does not automatically grant stay. Notification, objections, reapplication, annulment proceedings, stays of execution and distinct removal decisions remain matters tied to the actual decision and its effects; they do not by themselves establish the basis for this residence category.

This purpose requires a competent-authority document stating that the foreigner must remain for a specified period, followed by residence documents, conditions and follow-up. A challenge to an immigration decision does not automatically become that document, and not every interim order has identical effects. Have the actual decision examined appropriately rather than transferring court deadlines into a residence application.

14. Two examples of organising facts without promising approval

Example one: a foreign national has a future hearing paper and believes it extends their stay. They check status and expiry and establish whether a competent-authority document states that presence is necessary and for what period in the required form, instead of relying on the appointment alone. If a qualifying situation exists, they organise the residence application and conditions; they do not turn the hearing date into new permission themselves.

Example two: a foreign national already has an administrative request requiring presence for a specified period, which changes during residence processing. They keep both documents and the sequence of change and contact the issuer and Migration Management to update the file while tracking housing, cover, resources and current permission. They assume neither fee or insurance exemption nor automatic extension from the new letter. These examples establish no individual eligibility, decision or right to remain or travel.

Frequently asked questions

Does having proceedings grant this residence?
Not automatically. Check the authority document requiring presence and specifying duration, and the residence conditions.

Is every witness or party to a dispute eligible?
We do not establish eligibility from the role alone. Check the competent request or decision and required content.

Which situations does the checklist name?
Administrative requests and decisions and judicial requests and decisions, supported by a document specifying necessity to remain and the period.

Does a lawyer’s letter replace the authority document?
We assume no such substitution. Representative status and correspondence do not automatically replace a competent-authority request or decision.

Is the hearing date the residence duration?
No. The document must specify the required period, followed by application and duration assessment under the law.

Does every paper need notarisation and an apostille?
We impose no universal requirement. Verify the signature, seal or electronic signature, accepted copy and case-specific translation.

Is the letter itself a residence permit?
No. Evidence of the basis does not replace the immigration application, conditions, decision or applicable status document.

Will I receive two years?
It is not guaranteed. The statutory ceiling does not settle the period granted for the document and circumstances.

Are fees or insurance automatically waived because of proceedings?
The selected sources establish no blanket exemption under that description. Check cover and the legal exemption applicable to each item.

Is TRY 964 the total file cost?
No. It is the 2026 document charge, separate from harç, services, housing and cover, and is no established 2027 tariff.

When are address evidence and UETS needed?
Follow stage and checklist: registration and evidence for extensions and transfers, UETS where requested with the age exception, and the stated first-application timing.

Does assessment start when the case is registered?
No. The residence period described in guidance starts with complete information and documents at the competent authority, not registration of the dispute.

Does every missing-item request give me 30 days?
We assume no universal allowance. Follow your notice and delivery channel and retain response evidence.

What if necessity or duration changes?
Document the change and promptly ask the issuer and Migration Management about the procedure. Assume neither automatic cancellation or extension nor a uniform notification period.

Can I travel on the court paper?
Do not treat it as departure and return permission. Check your status document, travel conditions and any actual restrictions or duties with the competent authorities.

Does residence give me permission to work?
Not by itself. Applicable work authorisation or exemption has its own route.

Does a residence-refusal claim become this purpose?
Not automatically. Objections, interim relief and decision effects require actual assessment; the claim alone is not this category’s necessity document.

Should I use the divorce or sponsor-death papers in the following checklist lines?
No. They concern transfer from family to short-term residence, not a shared judicial or administrative request/decision checklist.
