Introduction: why the basics matter
Buying in Türkiye involves more than signing a contract. Understanding title deeds, valuations, notarial procedures and location restrictions helps protect your money and any residence plans. This introductory guide explains what foreign buyers may acquire, the restrictions to check, ownership responsibilities and common mistakes. It provides general information; obtain qualified advice for the actual purchase.
Who may own property?
Many foreign nationals may acquire property, subject to nationality and other statutory restrictions. Confirm your eligibility at the time of purchase.
- Individuals and companies are governed by different acquisition rules; forming or using a company does not automatically remove restrictions.
- Potential acquisitions include apartments, villas, shops, offices and, where permitted, land.
- Special restrictions may apply to particular nationalities or locations.
Have the land registry and an independent lawyer confirm the position for you.
Property types and restrictions
Subject to eligibility and checks, a foreign buyer may acquire:
- An apartment in a complex or standalone building.
- A detached villa or one within a development.
- A shop or office.
- Development or agricultural land where permitted and subject to its specific conditions. For undeveloped property, submit a project to the competent public authority within two years of acquisition.
Military, security and other restricted areas require particular checks; foreign acquisition may be prohibited or require approval.
Area limits
- The general individual limit is 30 hectares nationwide.
- Total foreign individual ownership is also subject to a district-level limit of 10% of the area open to private ownership.
- These ownership limits are distinct from restrictions on foreign-resident address registrations.
Confirm any applicable exceptions and restrictions with Tapu ve Kadastro or the lawyer handling the official file.
Understand the title status
The tapu is the official title record. Key descriptions include:
Arsa: development land
- A land registration does not itself establish a completed, independently registered apartment. Check the actual registered property and any buildings.
Kat irtifakı: construction servitude
- A registered right tied to a land share and a designated independent unit in a planned or developing building.
- It differs from completed condominium ownership; check construction, occupancy and conversion status.
Kat mülkiyeti: condominium ownership
- Independent units are registered under the completed building’s condominium regime.
- Check the registered residential or commercial use, unit and floor details.
For a completed apartment, condominium status is important, but it does not by itself prove structural safety or that later alterations are authorised. Check the title, permits and building together.
Residence restrictions and ownership restrictions
- Some neighbourhoods or districts restrict new foreign-resident registrations, with scope and exceptions determined by official instructions.
- A legally owned home may therefore not support your intended residence application.
- Military, security or other designated areas may restrict the purchase itself.
Do not buy solely because a property is cheap. Establish the precise mahalle, or neighbourhood, and ilçe, or district, and check both acquisition and residence eligibility through official information and qualified advice.
A home, an investment or both?
- Prioritise quiet surroundings, schools, healthcare, transport and a suitable family environment.
- Daily comfort may matter more than rental yield.
- Investigate demand from students, workers or visitors.
- Assess infrastructure and development plans without assuming they guarantee appreciation.
- Calculate net annual rental yield and consider currency and regulatory risks.
- Choose a property that suits you now and has credible future rental or resale demand.
- Assess the neighbourhood, building and locally sought-after sizes and layouts, which may include 2+1 or 3+1 apartments.
Ownership rights and responsibilities
Rights, subject to applicable rules:
- Registered ownership in your name.
- Sale or transfer, taking account of mortgages, attachments and any investment-citizenship holding commitment. A mortgage does not itself automatically prevent transfer, but remains an encumbrance requiring legal arrangements.
- Lawful residential or commercial letting.
- Transmission to heirs under the applicable rules. Inheritance of immovable property located in Türkiye is governed by Turkish law; obtain advice on nationality, documents, taxation and your family’s circumstances.
Responsibilities:
- Pay property tax where due and any applicable complex charges.
- Use appropriate tenancy agreements and comply with letting requirements.
- Observe building, housing, noise and occupancy rules.
Keep electronic copies of the title, tenancy agreements and tax and service-charge receipts.
Common mistakes
Signing documents you do not understand
- Obtain an appropriate translation and legal explanation.
Making substantial undocumented cash payments
- Use verified banking channels and retain records.
Understating the price on the title declaration
- This can create tax exposure and problems with citizenship-related checks, resale and claims.
Relying on an unverified intermediary
- Check the agency’s identity, address and registration, and appoint your own independent lawyer.
If a property is far cheaper than comparable homes, investigate the reason and any hidden legal or planning problem.
Ownership, residence and citizenship
Ownership does not automatically guarantee residence or immediate citizenship. Property-based residence and citizenship by investment have separate eligibility, value and procedural requirements that may change.
Do not buy on a verbal guarantee. Assess the property’s quality, location, rental demand and resale prospects first, then check any additional immigration benefits separately.
Your rights and obligations in perspective
Eligible foreign buyers can hold registered ownership and participate in a varied market, with potential rental income and capital appreciation where conditions support it.
In return, understand the rules before buying, comply with taxes and contracts, and review sales offers calmly.
The next guides in Real Estate & Investment cover the purchase process, prices and taxes, cities and neighbourhoods, rental returns, and financing or instalments.
