Using a Turkish Notary: Certification, Copies and Common Mistakes
A noter carries out formal notarial acts involving documents, signatures and legally specified transactions. Notarial certification can provide important evidence or meet a procedural requirement, but it is not a guarantee that every claim in a document is correct.
1. Common notarial services
- Certifying signatures on agreements, declarations or undertakings.
- Issuing certified copies where the procedure allows them.
- Drawing up powers of attorney in the required form.
- Certifying sworn translations and other authorised notarial acts.
2. When foreign residents may need a notary
Examples include authorising someone to complete a transaction, providing a certified signature requested by an institution, notarising a foreign-language document's translation, making an undertaking or obtaining an accepted certified copy. The receiving body's requirements determine whether the service is needed.
3. Before attending
Ask which original identity document is accepted and whether it needs a certified Turkish translation. Bring the document concerned and the necessary copies, identifying numbers and transaction details. Some procedures require photographs or additional records. If your Turkish is insufficient to understand the proceedings, arrange the required sworn interpreter in advance; availability is not guaranteed at every office.
4. At the office
- Identify the exact service: power of attorney, signature certification, certified copy or translation.
- Arrange the required translation or interpretation.
- Review the final wording and all personal and transaction details.
- Understand the document before signing and clarify any unexpected clause.
- Pay the applicable charges, collect the required copies and retain the transaction reference.
5. Particular care with powers of attorney
Grant the authority needed for the task and consider suitable limits on scope, duration, receipt of money and delegation. Check names, dates and identifying numbers. Keep a clear copy after certification. Independent review is useful for sensitive powers or substantial transactions.
Common questions
Is notarisation the same as an apostille? No. An apostille authenticates an eligible public document's origin for use abroad where the Convention applies. Whether it is needed, and whether it concerns the original or a notarised translation, depends on the document and destination.
Can I use a notary without a residence permit? A passport or another accepted identity document may be sufficient for certain procedures, but the notary must confirm the requirements for your transaction. Do not assume every procedure has the same eligibility or documentation rules.
Careful preparation, accurate details and a clear understanding of what you sign reduce avoidable mistakes. Notarisation is a legal procedure, not simply a stamp to obtain without checking the document.
