🏠 Rental Contracts in Türkiye 2026: Key Clauses and Practical Protection

1) Why does the agreement matter?
Disputes over deposits, repairs, increases, early departure or the landlord's authority often emerge after moving in. A clear agreement and good records help prevent misunderstandings and support your position if a dispute arises.

2) Ten points to clarify
  1. The landlord's identity and authority, and your name as recorded in your identity documents.
  2. The full property address, including the unit and floor.
  3. The start date and agreed term.
  4. The rent, payment currency and monthly due date, subject to applicable currency rules.
  5. The correct recipient account and payment reference.
  6. The deposit, lawful holding arrangement and return conditions.
  7. Responsibility for utilities, building charges and other agreed expenses.
  8. The property's condition, furnishings, defects and meter readings at handover.
  9. Notice, early termination and the handover process, subject to mandatory tenant protections.
  10. Renewal and rent-review terms within the applicable statutory rules.
Contract wording cannot simply remove mandatory protections. Check unusual deposit, increase or eviction terms before signing.

3) Warning signs
Pause if ownership or authority cannot be verified, cash is demanded without proper documentation, the contract has blank spaces or missing identities, departure terms are unclear, or promissory notes are demanded without a justified explanation. Do not assume a fixed term automatically allows the landlord to evict at its end.

4) Record the handover
Take dated photographs or a comprehensive video of the rooms and fixtures. Record electricity, water and gas meter readings. Prepare a defect and inventory list, signed by both parties if possible, and keep payment records.
Rent-payment documentation is not merely a preference: the Revenue Administration's rules generally require residential and business rent payments to be documented through banks or PTT, subject to specified exceptions.

5) Does the tenancy contract need a notary?
An ordinary tenancy agreement is generally not subject to a universal notarisation requirement, though particular transactions or administrative uses can require specified formalities. Notarisation may assist proof but does not validate unlawful clauses or establish ownership. Confirm the receiving authority's requirements where the agreement will be used for an official application.

6) If a dispute starts
Gather the agreement, transfers, handover evidence and messages. Ask whether a formal notice, Ihtarname, is appropriate and what it should say. Distinguish a civil tenancy dispute from evidence of a separate offence. Many rental court claims require prior mediation, while certain non-judgment eviction enforcement procedures are excluded; check the official mediation guidance.

Practical takeaway
Verify the parties and property, clarify lawful payment and deposit terms, record the handover and keep documents throughout the tenancy.
