Notarial Notices in Türkiye: Preparing and Serving an Ihtarname
What is an ihtarname?
An ihtarname is a formal notice used to communicate a demand, warning or legal position. It is often sent through a notary to request payment, performance of an obligation, delivery of an item, an end to harmful conduct or termination of an agreement where the law allows it. Its principal value is evidence of the content and service of the notice. It does not establish that the claim is legally valid or oblige a court to rule in your favour.
Common uses
- Demanding an overdue payment from an individual or company.
- Requesting delivery of goods, documents, keys or possessions.
- Identifying a failure to fulfil a contractual obligation.
- Giving a legally required termination or other contractual notice.
- Recording a demand before taking the next appropriate legal step.
When another step comes first
For immediate threats, violence or other urgent danger, contact the police or call 112. Do not wait for a notarial letter to be served. Service may also be difficult if the recipient's identity or address is incorrect. A notice does not replace a criminal report, required mediation, a court application or a short objection deadline.
Prepare a clear notice
- Identify yourself accurately and provide the necessary contact and identity details.
- Identify the recipient and the correct address for service.
- Set out the relevant events and dates briefly and factually.
- State exactly what you request: a specified payment, delivery or other action.
- Use the period required by the applicable law or contract, and explain the intended lawful next step if the demand is not met.
The practical process
Prepare a draft in the form accepted by the notary, with sworn translation or interpretation where needed. Bring the recipient's details and supporting records, ask for an ihtarname, review the wording and sign. Keep your copy and transaction number, and obtain or follow up the proof of service. The notary arranges service through the applicable formal channels; dispatch and legally effective service are different events.
Avoid common mistakes
Avoid vague demands, incorrect addresses, threats and arbitrary deadlines. Check whether the notice needs to specify an amount, obligation, legal ground or consequence. Sending a letter cannot cure a missed court deadline.
A short drafting outline
Use this to organise the facts, then have the requirements checked for the actual dispute. A formal notice records a legal demand; careful wording and valid service determine what it can achieve.Sender: [name and necessary identifying details]
Recipient and service address: [complete accurately]
Relevant facts: [brief chronology and agreement concerned]
Demand: [precise payment or action requested]
Applicable period: [the legally appropriate period and when it begins]
Next step: If the demand is not met, I reserve the right to pursue the appropriate legal remedies.
Date and signature: [complete as required]
