1️⃣ 🇹🇷 Turkish Citizenship by Birth and Descent 2026

Birth in Türkiye does not normally confer Turkish citizenship by itself. Citizenship at birth is principally based on descent from a Turkish parent. Place of birth is relevant in specified situations designed to prevent statelessness.

These rules are governed by Citizenship Law 5901 and differ from naturalisation through residence, marriage or investment. Where the legal conditions are met, citizenship from birth takes effect from the birth date even if registration comes later.

2️⃣ 📊 Practical overview

SituationRule
1️⃣ Turkish parentParentage and citizenship at birth matter
2️⃣ Birth in TürkiyeLocation alone does not grant every child citizenship
3️⃣ Risk of statelessnessThe child’s statutory safeguards are assessed

3️⃣ ⚖️ Two bases for citizenship at birth

  • 1️⃣ Descent — soy bağı: citizenship through a Turkish mother or father under the statutory parentage rules.
  • 2️⃣ Place of birth — doğum yeri: birth in Türkiye where the child cannot acquire a nationality through either foreign parent.

4️⃣ 👩‍👦 A Turkish mother

A child whose mother was Turkish at birth acquires Turkish citizenship whether born in Türkiye or abroad, whether the father is Turkish or foreign, and whether the parents were married. Acquiring the father's nationality as well does not by itself remove the Turkish entitlement. Birth and maternity must be officially established.

5️⃣ 👨‍👧 A Turkish father

For a child born within a legally recognised marriage, a Turkish father at the time of birth confers citizenship regardless of birthplace.

If the father is Turkish, the mother foreign and the child was born outside marriage, an assertion of paternity is insufficient. Parentage must be legally established through a recognised procedure, such as formal acknowledgment, the legal effects of a subsequent marriage, a final paternity judgment or another applicable Civil Code mechanism. Once the relevant parentage conditions are established, the citizenship is treated as acquired from birth rather than merely from the date the registration document was issued.

6️⃣ 🗓️ The parent's nationality at birth

The relevant question for citizenship by descent is whether the mother or father was Turkish when the child was born. If both were foreign then one later naturalised, an adult child does not automatically become Turkish by descent. A minor may instead qualify through the parent's acquisition, subject to the applicable custody, consent and family rules.

7️⃣ 🏥 Birth in Türkiye to foreign parents

If a child can acquire either parent's nationality, birth in an Istanbul, Ankara or other Turkish hospital does not automatically make the child Turkish.

Citizenship based on place of birth applies where a child born in Türkiye cannot acquire a nationality through either parent. This may involve stateless parents, unknown parents or nationality laws that do not transmit either parent's citizenship. The authority requires appropriate official evidence of the legal position; a verbal statement that the child is stateless is insufficient.

8️⃣ 👶 A child found in Türkiye

A foundling in Türkiye is presumed born there unless proved otherwise. Registration uses the competent authorities' records and the available evidence, with the statutory place-of-birth rules protecting against statelessness.

9️⃣ 🌍 A child born abroad

A foreign birthplace does not prevent Turkish citizenship by descent. Register the birth through the competent Turkish embassy or consulate, or the relevant population authority in Türkiye with the required documents. Prompt registration supports identity cards, passports and proof of the family relationship.

1️⃣0️⃣ 🔞 Registration after 18

Failure to register before adulthood does not automatically extinguish citizenship acquired by descent. A person born abroad to a Turkish parent whose birth remained unregistered may have their citizenship status determined following investigation and proof of parentage.

This is a determination of citizenship from birth rather than an ordinary new naturalisation application. It may require more extensive checks of the Turkish parent's identity, birth certificate, parentage, matching names and dates, and possible duplicate or conflicting records. Follow the special procedure for an adult rather than assuming the ordinary child birth notification is sufficient.

Organising documents and an online application

1️⃣1️⃣ 📄 Documents for descent cases

The list depends on the country and family history. It may include:
  • An application form or petition and original birth certificate.
  • The Turkish birth notification record.
  • Turkish identification or population records for the Turkish parent.
  • Identification or nationality evidence for the foreign parent.
  • Evidence of whether the child acquired the foreign parent's nationality where requested.
  • Marriage, divorce or parental death records where relevant.
  • Acknowledgment or a paternity judgment for an unmarried Turkish father where required.
  • Statements from parents or, in some older files after their death, siblings.
  • Two 50×60 mm biometric photographs where requested.
  • Name-change evidence and explanations of identity discrepancies.
Older births, incomplete registers and inconsistent names or dates may require additional evidence.

1️⃣2️⃣ 📑 Documents for place-of-birth cases

The usual list includes VAT-2, proof of birth in Türkiye, the Turkish birth record, official evidence that neither parent's nationality was acquired, proof of parental statelessness where relevant and biometric photographs where applicable.

1️⃣3️⃣ 🌐 Foreign documents

Depending on the issuing country and applicable agreement, documents may need an apostille or consular authentication, a sworn Turkish translation and notarial certification. Complete the required authentication of the original as well as translation. Check names, birth date and parents' details consistently throughout.

1️⃣4️⃣ 🏢 Where to apply

Use the competent governorate or population and citizenship authority in Türkiye, or a Turkish mission abroad. A parent or lawful guardian acts for a child. A special power of attorney may be accepted for some steps; postal correspondence is not a substitute for the required formal procedure. Confirm the appointment and responsible office through NVI or Alo 199.

1️⃣5️⃣ 🔄 The practical sequence

  • 1️⃣ Identify descent or place of birth as the legal basis.
  • 2️⃣ Obtain birth and parental records.
  • 3️⃣ Resolve identity discrepancies.
  • 4️⃣ Complete authentication and required translations.
  • 5️⃣ Submit to the competent authority.
  • 6️⃣ Respond to record, parentage or additional-document enquiries.
  • 7️⃣ Complete population registration.
  • 8️⃣ Apply for the identity card and passport.

1️⃣6️⃣ ❌ Common problems

These include relying on birthplace alone, unestablished paternity, inconsistent spelling across passports and birth records, translating without required original-document authentication, missing proof of non-acquisition in a place-of-birth claim, assuming a parent's later naturalisation automatically covers an adult child, and concealing foreign marriage, divorce or name changes.

1️⃣7️⃣ ❓ Frequently asked questions

A tourist's child born in Türkiye? Not automatically Turkish if the child can acquire a parent's nationality.

A Turkish grandparent? This can help trace records, but the chain of descent and the parent's citizenship at the applicant's birth must be established.

Keeping another nationality? Türkiye recognises multiple citizenship, but the other country's law also matters.

Property in a child's name? Property ownership does not create citizenship by birth or descent.

Adoption? Acquisition through adoption is a separate statutory route, not citizenship from birth.

1️⃣8️⃣ ⚠️ Complex parentage files

Old records, birth outside marriage, missing documents and identity differences can require further official evidence or a judgment. Obtain the final checklist from the authority handling the file.
