A failed combi boiler or a damp patch does not, by itself, answer “Who pays?”. Responsibility depends on the cause, the property's condition at handover, whether the work is ordinary maintenance or the remedy of a defect, and whether late reporting or misuse increased the damage. The practical priorities are notifying the landlord, establishing the cause and arranging work and payment without turning a repairable problem into a rent or deposit dispute.

Information reviewed: 24 October 2026. This guide draws on the defect, care and maintenance provisions of Turkish Code of Obligations No. 6098 and Justice Ministry mediation guidance. Parliament's text is the law as adopted; this is not a claim that a new repairs law was enacted in 2026 or that every amendment has been audited. Financial remedies and termination depend on establishing the conditions of the particular case.

1. Fitness for occupation, careful use and ordinary maintenance

Article 301 requires the landlord to deliver the rented property fit for the agreed use and maintain that condition throughout the tenancy. For residential premises, this rule cannot be changed to the tenant's disadvantage. Conversely, Article 316 requires careful use consistent with the agreement, while Article 317 places the costs of cleaning and maintenance needed for ordinary use on the tenant, with local custom also considered. A general “all maintenance is the tenant's responsibility” clause therefore does not settle every defect; nor does the landlord's obligation automatically make every technician's bill the landlord's liability.

These provisions contain no national lira threshold separating a “small” repair from a “major” one, or a list assigning every boiler part to one party. Price alone is insufficient: routine cleaning can be maintenance, while even a cheap repair of an existing defect can engage a different obligation. Separate ordinary deterioration and the appliance's age from proven breakage or neglect.

Type of issueWhat to examine firstPractical response
Routine cleaning and maintenanceOrdinary use, operating instructions, local custom and the agreement within legal limitsArrange it when due and keep service records; do not automatically present it as a defect claim
A defect preventing or impairing useWhether it predated handover, its cause and effect, and whether remedying it is your responsibilityNotify the landlord without delay and document the requested remedy and appropriate time allowed
Damage caused by misuse or neglectThe cause report, maintenance and notification records, and the connection between conduct and damageDo not accept or deny liability solely because of a part's name or an unsupported verbal opinion
An optional improvement or alterationWhether it is a necessary repair or a property upgrade or changeArrange written landlord consent and terms covering cost and reinstatement before proceeding

2. Defects at handover and defects appearing later

Article 304 distinguishes substantial defects at delivery from minor ones. For substantial initial defects it refers to debtor-default or subsequent-defect remedies, and for minor initial defects to subsequent-defect remedies. Under Article 305, a later defect may support a request for remedy, a proportionate rent reduction or compensation, with termination reserved for a substantial defect under its conditions. Discovering a fault after moving in does not alone prove that you caused it. Recording an issue on a handover sheet likewise does not terminate the tenancy or establish a particular discount.

Before occupation or promptly on discovery, preserve the handover record, original-condition photographs and agreed appliance inventory. Record promises to repair, deadlines and who will coordinate. If you have already entered into the tenancy, use the applicable defect process rather than assuming that refusing keys or leaving automatically cancels it. Where the agreed description or furnishings are disputed, retain the advertisement, agreement and relevant correspondence without assuming that one advertisement photograph establishes every contractual term.

3. Boilers, leaks, damp and appliances: diagnose before allocating costs

ExampleEvidence useful in establishing the causeWhat not to assume
A combi boiler stops or fails to heatError code, model, a technician's report on the part, age and cause, and maintenance historyThat every fault belongs to the tenant because they use it, or every call-out belongs to the landlord
A leak below a sink or inside a wallIdentify whether it comes from a used fitting, concealed pipe, neighbouring flat or common lineThat the occupant where water appears is ultimately liable, or painting will remedy the source
Recurring damp or mouldTiming, photographs over time, and investigation of water sources, insulation and ventilation where neededThat every patch proves tenant ventilation failure, or necessarily proves a structural defect
A fridge or washing machine rented with the flatInventory, ownership, handover condition, warranty and cause reportThat it belongs to the tenant, or the tenant can choose any replacement at the landlord's expense
A tenant-owned appliance or installationPurchase record, installation method, any damage to the property and the fault's connection to itThat the landlord guarantees tenant belongings merely because they are inside the flat

For a combi boiler, distinguish ordinary servicing from remedying a defect affecting heating or hot water. Ask the technician to record what was examined, the likely cause and anything not established. “Replace the appliance” without an explanation does not show why repair is unsuitable or who should pay. Do not dismantle gas, electrical or safety components yourself.

For damp, do not let an argument over responsibility postpone addressing the source. Fixing a leaking pipe and repainting its effects are different jobs. Discuss stopping the source, drying and finishing in the appropriate order, including access through building management or another flat. If a common element is involved, notify both landlord and management to coordinate access. This neither automatically releases the landlord from obligations towards you nor determines an automatic sum payable by every owner.

These examples organise investigation; they are not a definitive legal allocation table for each appliance. If the landlord says you caused the damage, request the event and evidence relied upon. If you say the defect was old, support that with records and diagnosis. More than one cause may contribute: an initial fault can worsen because reporting was delayed. Do not equate the original repair cost with additional consequential damage without examining the distinction.

4. Notice: what to write and how to retain proof

Article 318 requires the tenant to notify the landlord without delay of defects the tenant is not responsible for remedying; failure can make the tenant responsible for resulting damage. Do not wait to collect three quotations while a leak worsens, or rely solely on the caretaker saying they will tell the owner.

  1. Record the date, property address, exact fault location, when it appeared and its effect: no hot water, an unusable room or continuing leakage, for example.
  2. Attach clear photographs or video and any available diagnostic report, noting measures already taken for safety or to limit damage.
  3. Request a remedy, propose suitable inspection arrangements or ask who is authorised to attend, and offer reasonable access.
  4. Ask who will order the work and pay for inspection, parts and labour, including the approval limit for additional costs.
  5. Retain original messages, proof of sending and receipt, and replies. For a serious dispute, use a suitably documented notice with legal assistance where needed.

A call can speed the response, followed by written confirmation of what was discussed. WhatsApp messages, email and photographs may provide supporting evidence depending on the circumstances; this guide does not promise that every ordinary message satisfies every formal notice or termination requirement. Notifying an agent or office helps where they have relevant authority. If uncertain, also notify the landlord through the appropriate contact or address and preserve the record.

An adaptable practical wording is: “I notify you that … appeared in … on … and affects use of the home as follows … . I attach … and request inspection and remedy within a period appropriate to the problem. Please confirm the technician's appointment and approved cost in writing. Access can be arranged at … . I reserve my rights concerning the defect.” This organises the information; it is not a legally sufficient form for every case or a substitute for actually specifying an appropriate period.

5. Time to remedy, approval and access

Article 306 refers to an appropriate period, rather than prescribing seven or thirty days for every fault. Loss of heating in severe conditions, an active leak and a limited finishing repair are not equivalent in urgency or parts availability. Describe the damage and requested work, seek a realistic appointment and any temporary measure, and do not leave “we will repair it later” open-ended without follow-up.

Article 319 requires tolerating work necessary to remedy defects or prevent damage, while requiring suitable advance notice and regard for the tenant's interests. Cooperate with an agreed appointment and record reasons for any inability to attend or rescheduling. This does not authorise unarranged entry at any hour, or justify obstructing repair and then claiming for delay you caused.

Before non-urgent work, record the provider, scope, parts, price and approval. If inspection reveals another fault, obtain an updated quotation and further approval before expanding the work. Agree whether the landlord pays the technician directly or you pay first under an explicit reimbursement arrangement. Permission to repair is not necessarily agreement to deduct any amount from rent. This describes an agreed coordination route, not the removal of Article 306 rights where its conditions are met; requesting approval does not establish an additional consent requirement for every exercise of that right.

6. Handling an urgent situation

Where gas, electricity or flowing water threatens people, move away from danger and contact the utility's emergency service or an appropriately authorised professional. Do not touch wet wiring or work on gas components yourself. Take only safety measures possible without exposing yourself to danger, and promptly notify the landlord, management or other relevant provider.

Document the severity, contact attempts and what could not wait. Ask the technician to distinguish urgent damage limitation from permanent repair or an upgrade. Keep the cause report, before-and-after photographs, replaced parts where safely practicable, invoice and proof of payment. Urgency can explain rapid intervention; it does not automatically make every replacement or expense recoverable or deductible. If the normal sequence could not be followed, obtain an appropriate legal assessment of cost recovery rather than treating Article 306 as unconditional permission to dispense with notice and time to remedy in every situation.

7. Landlord-funded repair, deduction, rent reduction and compensation differ

RouteWhat the provisions sayWhat must be established
Requesting repairArticles 301, 305 and 306: remedying a defect within the obligation's scope and an appropriate periodCause, effect, notification and opportunity to remedy
Repairing on the landlord's account and deducting the claimArticle 306: if not remedied within the appropriate period, the tenant may have it remedied on that account and deduct the resulting claim from rentThe route's conditions and necessary, evidenced cost; an invoice alone does not prove all conditions
Seeking a rent reductionArticle 307: a proportionate reduction for a defect affecting use, from the landlord learning of it until it is remediedKnowledge, duration, impaired benefit and the amount; no national fixed percentage
Compensation for lossArticle 308: the landlord is liable for resulting loss unless absence of fault is provedLoss, causation and evidenced amount; a hotel or damaged-furniture bill is not guaranteed reimbursement
Termination for a substantial defectArticle 306: agreed use becomes impossible or substantially impaired and the defect remains after the time allowedSeriousness, notice, legal form and handover; simply leaving is not a complete procedure

The practical rule is do not automatically deduct every repair bill from rent. Article 306 can provide a deduction right, but disputed grounds, procedure or costs can turn an underpayment into a separate rent dispute. If you agree, record the amount, rental period, settlement method and balance paid, with supporting documents. If you disagree, assess the route before acting; do not stop the entire rent as a penalty against the landlord.

A reduction for impaired use differs from recovering the price of a part. There is no rule that a failed boiler automatically means half rent, or that rent must always be divided equally by the number of unusable rooms. Remedy or a suitable defect-free equivalent, including the Article 306 provisions concerning prompt replacement and full compensation, may affect which choices remain available. Do not ignore a proposed solution and assume every remedy remains unchanged.

If considering termination, understand the effect before signing a “voluntary departure with no claims” record. An asserted defect does not guarantee that all early-departure obligations disappear. Prepare the condition evidence, notices and time allowed, and properly address the termination ground, return of keys and reservation of outstanding claims.

8. Quotations and invoices: controlling the cost

This guide establishes no national 2026 tariff for a call-out, boiler part or damp treatment. Costs vary with the city, appliance, cause, access and urgency. Obtain a written quotation in lira specifying validity and tax rather than relying on an old advertised price.

ItemWhat the quotation or record should clarify
Inspection and call-outAttendance and diagnostic fees, whether credited against repair or payable if repair is declined
Parts and labourPart name, model and condition, installation, tax, warranty and exclusions
Associated workOpening walls, drying, painting, waste removal and reinstatement, and who performs each part
Timing and changesAppointment and expected duration, with renewed confirmation before any extra amount
Payment and settlementInvoice, proof of payment, who pays and reimbursement method, separately from rent settlement

A second quotation for non-urgent work can assist comparison, but it is not presented as a general legal requirement established here. An invoice issued to the payer evidences expenditure; it does not alone establish liability. If the proposal includes a nicer finish or higher-specification appliance, separate the improvement from necessary repair and agree who pays the difference.

Article 321 addresses written consent for tenant alterations and improvements, along with restoration and increased-value claims. Approval of an improvement is not, by itself, a promise to repay all expenditure; document cost arrangements separately. On departure, Article 334 excludes tenant liability for wear and deterioration resulting from agreed use. A used property does not automatically require every component to be returned brand new.

9. If unresolved: one evidence file, mediation and the appropriate forum

Collect the agreement, inventory, original photographs, notices and receipt evidence, reports, quotations, invoices and rent-payment records, with a short chronology. Separate the repair request, rent reduction and damaged-belongings claim. Identify what is agreed and what remains disputed. Do not publish the landlord's identity, private-home images or account information in a public group to apply pressure.

The Justice Ministry's mediation FAQ explains that rental-relationship disputes generally require mediation before proceedings from 1 September 2023. The exception concerning non-judicial eviction under Law 2004 remains outside that generalisation; this guide does not explain enforcement eviction. Applications start at the courthouse mediation office or the civil peace court registry assigned the function where no office exists. A requirement to start mediation does not require accepting a proposed settlement.

Applying to the office is free under the official guidance, but that does not make an agreed mediation, lawyer, expert or lawsuit entirely free. Request current fee information, consider an interpreter if you do not understand Turkish, and arrange appropriate authority where a lawyer represents you. Read any agreement and establish the release's scope, amount and performance dates before signing. If no agreement is reached, the final record forms part of the applicable court route.

Article 4 of Civil Procedure Code No. 6100 assigns rental-relationship disputes, including monetary claims, to the civil peace court, Sulh Hukuk Mahkemesi, within its scope. A claim against a landlord to remedy rented premises is not automatically a consumer complaint against a retailer or simply a CİMER submission. Claims against a technician, manufacturer, neighbour or insurer may follow different routes. Where these overlap, establish the defendant, remedy, competent forum and venue with appropriate assistance.

If evidence will disappear when a leak is removed or an appliance dismantled, or urgent protection is needed, promptly obtain advice on preservation of evidence or a suitable interim measure. Do not assume negotiation preserves every deadline, or keep a danger in place merely to preserve a photograph. This guide sets no single lawsuit deadline for all these demands; their nature varies, while defect notification must be made without delay.

10. Practical questions before paying or settling

Is annual boiler servicing always my responsibility?
Examine the ordinary nature of the service, agreement, local custom and appliance history. Routine servicing differs from remedying an earlier defect or replacement due to age. Diagnosis matters; the invoice's label “maintenance” does not decide liability.

The technician blamed ventilation for damp. Is the discussion over?
Ask what was inspected, the evidence and whether leakage or defective insulation was excluded. A detailed report is more useful than a general assertion. Further investigation may be needed if the source remains disputed. Continue notification and damage mitigation while it is investigated.

I paid to stop a leak because I could not reach the landlord. Can I deduct it immediately?
Preserve evidence of urgency, contact attempts, scope and cost, and notify the landlord of what happened. Reimbursement and deduction are not guaranteed by payment alone. Establish the claim's basis and conditions before reducing rent.

Can I buy a new boiler because the old one failed?
Do not jump from a fault to a replacement of your choice. Establish repair feasibility, warranty, cost, specification and approval. The suitable remedy may be repair or an appropriate equivalent; a higher-specification upgrade is not automatically owed.

Can the landlord postpone repair until the tenancy ends?
Keeping the property fit for its agreed use is an ongoing obligation. Address seriousness, duration and remedy possibilities, then follow the appropriate notice, time and remedy process. Neither every delay is acceptable nor every fault a basis for immediate termination.

What should I retain after completion?
Keep the cause and work report, parts details, invoice, payment, warranty, result photographs and settlement approval. Record whether the source was cured but finishing or other loss remains. Do not sign a general release where the agreement covers only a specified repair.
