Quick summary:
The temporary 25% limit on residential rent increases covered renewals up to and including 1 July 2024. Ordinary renewals from 2 July 2024 returned to the Consumer Price Index (CPI) rule; the change was already in force before 2025.

The relevant framework is Article 344 and Temporary Article 2 of the Turkish Code of Obligations.

1️⃣ What changed?

The temporary 25% cap ceased to apply to subsequent renewal periods.
For an ordinary annual renewal:
The agreed increase cannot exceed the change in twelve-month average CPI.
The parties may agree a lower increase; the ceiling does not automatically override a lower contractual rate.
Separate rules apply to judicial rent assessments after five years and to foreign-currency leases. The ordinary renewal ceiling should not be treated as a universal rule for every case.

2️⃣ A practical example: July 2025

The June 2025 CPI release, published on 3 July, recorded a 43.23% change in twelve-month average prices. This was the benchmark commonly used for July 2025 rent renewals.
For an ordinary residential renewal to which that figure applied:
The increase could not exceed 43.23%, subject to any lower contractual rate.
An agreement exceeding the applicable legal ceiling could be challenged; the excess is not made valid merely by agreement.

3️⃣ Responsibilities and practical checks

Tenants should check:
The tenancy’s start and renewal dates.
The annual increase clause.
The official CPI release applicable to the renewal before accepting a proposed rate.
Landlords should:
Observe the applicable CPI ceiling and contractual terms.
Record the agreed rent in writing to reduce disputes.
Under the Ministry of Justice guidance, since 1 September 2023 mediation for rental disputes is generally a prerequisite before filing a court claim, subject to statutory exceptions, including specified eviction proceedings through enforcement without a prior judgment. An unresolved dispute may then proceed to the competent court.

4️⃣ What this meant for residents

Long-standing tenants could face substantial renewal increases in 2025 after the temporary cap ended; a 25% ceiling had limited increases rather than frozen rent.
Anyone considering a new tenancy should:
Negotiate a reasonable future increase clause within the law.
Choose an area that fits a medium-term budget, rather than relying only on the initial asking rent.

The 43.23% figure is a historical July 2025 example, not the rate for other renewal months. An individual dispute requires assessment of the contract, dates and type of claim.
