1️⃣ 🚫 Working Without a Permit in Türkiye in 2026: Fines, Removal and Employer Liability

Employing a foreign national without a valid work permit or lawful exemption is a separate offence for both employer and worker. Consequences can include substantial fines, SGK liabilities, residence or removal proceedings and recovery of return-related costs from the employer.

A tourist, student or family residence permit does not automatically authorise work. Submitting a first work permit application does not allow work to begin while it is assessed.

2️⃣ 📊 Practical overview

Violation2026 base fine
1️⃣ Employer, per foreign workerTRY 102,503
2️⃣ EmployeeTRY 40,977
3️⃣ Self-employed workerTRY 82,010

3️⃣ ⚠️ What counts as unauthorised work?

Examples include working without a permit or documented exemption, starting before approval, continuing after expiry without a valid renewal route, working for a different employer or outside the authorised role/workplace, working after cancellation, exceeding an exemption’s scope or duration, unauthorised self-employment, using someone else’s permit or presenting a forged document.

A fixed-term employment permit is tied to its authorised employer and work. A residence card, health insurance, SGK registration, company ownership, employment contract, application receipt or promise to obtain a permit later is insufficient by itself. Mavi Kart holders and groups expressly covered by a statutory or treaty exception have different rules; verify the exact entitlement first.

4️⃣ 🔄 The limited renewal exception

After a renewal application made before the existing permit expires, work may continue during assessment for up to 90 days after expiry, ending sooner if the renewal is refused, for the same employer, at the same workplace and in the same role, with salary and SGK obligations continuing. This does not cover starting with a different employer: the new employer’s application is treated as an initial application and the appropriate permission must be obtained first.

5️⃣ 💰 Published fines for 2026

  • Employer: TRY 102,503 for each foreign national employed without permission.
  • Employee: TRY 40,977 for working without permission.
  • Self-employed foreign national: TRY 82,010 for unauthorised independent work.
  • Failure to meet the statutory reporting duty: TRY 6,805 per foreign national where the duty applies.
For example, the employer’s base fine for three unauthorised workers is TRY 307,509, before other liabilities. Repeat offences attract double fines. Separate labour, social security and tax penalties may also apply.

6️⃣ 🧾 The employer’s total exposure

The work permit fine is not the whole bill. There may be unpaid SGK contributions, late-registration penalties, interest and late charges, payroll tax liabilities, wage differences, employment entitlements and penalties for inaccurate wages or working days. The employer or representative can also be liable for the unauthorised worker’s accommodation, return and necessary health-related costs, including applicable costs for the spouse and children. Expenses paid by Migration Management may be recovered as a public debt.

7️⃣ 🔍 How breaches are identified

Labour and SGK inspections, police or gendarmerie checks, complaints, company records, payroll, data matching and workplace accident investigations can reveal unauthorised employment. Inspectors may examine contracts, payroll, attendance, permits and insurance records. The worker need not be physically present during an inspection if other evidence establishes the employment.

8️⃣ 🛂 Removal is a separate procedure

Law No. 6458 includes unauthorised work among the grounds for a removal decision. Distinguish the work-related fine, the governorate’s removal decision and any administrative detention decision: paying a fine does not cancel removal, and departure does not automatically erase debts.

Migration Management’s guidance gives a maximum of 48 hours for the relevant assessment and removal decision. Each person’s circumstances must still be assessed under the law.

9️⃣ ✈️ A period to leave voluntarily

An eligible person subject to removal may receive 15–30 days to leave, with a fee-free exit permission document. Leaving within the period may avoid an entry ban, but this is not a guarantee.

The period may be withheld where there is a risk of absconding, a breach of lawful entry/exit rules, false documents, an attempt to obtain residence through false information or a public order, security or health concern.

1️⃣0️⃣ 🔒 Administrative detention and alternatives

Unauthorised work does not mean everyone is automatically detained in a removal centre. A separate detention assessment may consider absconding risk, failure to leave, false documents, unlawful entry/exit or public order, security or health grounds. Alternatives can include residence at a specified address, reporting requirements, a financial guarantee, electronic monitoring or return counselling.

Detention can be challenged before the criminal judge of peace (Sulh Ceza Hâkimi). Making that challenge does not itself suspend detention.

1️⃣1️⃣ ⚖️ Challenging removal

The reasoned decision must be served on the person, legal representative or lawyer with information on remedies. A claim can be filed in the administrative court within 7 days of service; the authority that issued the decision must also be informed of the court application. Under the general statutory rule, removal is not carried out during the claim period or pending the court’s decision unless the person consents to departure. Seek legal help immediately. An objection to the fine is a different procedure with its own forum and deadline.

1️⃣2️⃣ 🩺 Protection against removal

Statutory protections require individual assessment. They include a real risk of death, torture or inhuman treatment on return; travel risks arising from serious illness, age or pregnancy; treatment for a life-threatening condition unavailable in the receiving country; protected victims of trafficking; and victims of serious psychological, physical or sexual violence until treatment is completed. Address and reporting obligations may still apply; humanitarian residence depends on its separate conditions.

1️⃣3️⃣ 🚧 Entry bans and unpaid costs

Removal can be accompanied by an entry ban. Its length depends on the breach, unlawful stay, additional violations, compliance with departure and payment of fines/costs, and any security concerns. Even without another ban, unpaid return costs borne by the state can affect readmission until settled.

1️⃣4️⃣ 🧑‍🎓 Students and other residents

Foreign associate, undergraduate and postgraduate students need the appropriate work permission. Associate and undergraduate students may work only after completing the first year, under the applicable rules. A student, family or tourist residence card, a flat, a company or a bank account does not by itself grant the right to work.

1️⃣5️⃣ 🧑‍💼 Employer checks before work starts

Inspect the original authorisation and verify it through the official permit enquiry service. Check the worker, employer, start/end dates, role, province, workplace and permit annotations. Register SGK on time, retain the contract, permit and payroll records, and plan renewal early. A photograph of a card or a pending first application is insufficient.

1️⃣6️⃣ 🛑 If a breach is discovered

Stop the unauthorised activity, check work and residence status and establish the lawful domestic or overseas application route. Do not restart simply because an application is filed. Correct SGK and payroll records where necessary, preserve inspection records and notices, obtain official receipts and do not sign documents you do not understand. Seek immediate legal advice for removal or detention. Forgery can turn an administrative matter into a criminal case.

1️⃣7️⃣ ✅ Final employment checklist

Permission must already be issued and valid on the start date; employer, role and workplace must match; SGK and salary declarations must be correct; renewal must be timely; the continuation period must stay within 90 days; reporting duties must be met; and any exemption must cover the actual activity and dates.
