Removal Decisions in Türkiye in 2026: Grounds, Safeguards, Notice and Court Challenges
A removal/deportation decision (Sınır Dışı Etme Kararı) is an administrative decision requiring a foreign national to leave Türkiye under Law No. 6458. An overstay or residence refusal does not itself mean removal is automatically carried out in every case. A separate reasoned decision and proper notification are required. For the specific Article 54 grounds, visa or visa-exemption overstay must exceed ten days, while cancellation of a visa is a separate ground. Permit expiry followed by more than ten days of stay without an acceptable reason and failure to leave within ten days after refusal of an extension are also distinct grounds. These thresholds do not authorise an extra period of lawful stay.

Who issues the decision?
The governorate (Valilik) acts on Migration Management’s instructions or on its own statutory authority. The decision must come from the competent authority, identify the legal ground and reasons, and be served on the person, legal representative or lawyer with information on its effect and remedy.
Grounds under Article 54
Specified grounds include false documents/information, unlawful entry or exit, relevant visa/residence breaches, cancellation of a residence permit subject to the applicable procedural exceptions, failure to depart following refusal of an extension, unauthorised work, entry despite an existing ban, public order/security/health concerns, terrorist or criminal organisation links, permit cancellation for misuse of residence for another purpose, and specified international protection outcomes after the final decision where no other lawful stay remains. Each statutory ground has its own conditions; this overview does not remove the need for individual assessment or the safeguards against removal.
Article 55 safeguards
A decision must not be made in protected cases, including serious indications of a risk of the death penalty, torture or inhuman/degrading treatment in the receiving country; serious travel risks arising from health, age or pregnancy; life-threatening treatment unavailable on return; trafficking victims receiving protection; and victims of psychological, physical or sexual violence until treatment is completed. The individual situation must be assessed. A specified address or reporting obligations may still be imposed.
Non-refoulement
The law prohibits return to torture or inhuman/degrading treatment or punishment, or to a place where life or freedom would be threatened for a protected reason such as race, religion, nationality, membership of a particular social group or political opinion. Explain the individual risk clearly and supply available evidence, reports and documents; obtain help urgently if gathering evidence is difficult.
Keep the notification
Retain the complete decision, service paper/envelope, date and time received, any interpretation provided, a separate detention decision and any departure permission. An unrepresented person must be informed about the result and challenge procedure. Do not sign a document you do not understand without interpretation.
Organising documents and an online application
The seven-day court deadline
The person, representative or lawyer can challenge removal in the administrative court within seven days of service. Do not use the ordinary 60-day administrative-claim limit for this decision. The issuing authority must also be informed that the court application has been lodged.Under the amended Article 53 procedure, the statutory fifteen-day determination period runs from completion of the dossier, or completion of any required interlocutory steps or hearing. It is not a guaranteed fifteen-day turnaround from initial filing. The seven-day period for filing the challenge remains a separate deadline. The administrative court’s decision is final under this special procedure.
Subject to the person’s informed consent to departure, the general rule prevents removal during the filing period and pending the court’s decision. Keep proof of the actual filing and notify the authority immediately. A draft petition or power of attorney alone is not a filed claim.
Possible grounds of challenge
Depending on the evidence, relevant arguments can concern an absent or incorrect legal ground, outdated facts, identity/date errors, documents overlooked, inadequate individual/family assessment, close family ties, a child’s best interests, essential treatment unavailable on return, torture/persecution risk, disproportionality, a valid status/application not properly considered or defective service. Link the facts to the law and evidence rather than relying only on general humanitarian statements.
Documents to gather immediately
Collect the decision and service evidence, passport and entry/exit records, residence/work cards, marriage and children’s birth documents, family residence evidence, medical reports, study/employment and address records, protection decisions, evidence of destination-country risk, related judgments/reports and official correspondence. Arrange certified Turkish translations where required.
An invitation to leave
Eligible people may receive 15–30 days to leave with a fee-free Çıkış İzin Belgesi. Leaving within the period may avoid an entry ban in qualifying circumstances, but other grounds, breaches and unpaid liabilities still matter. The period may be withheld for absconding risk, unlawful entry/exit, false documents/residence information or public order, security or health concerns. Detention requires its own decision.
Residence refusal is different
Residence refusal means the requested permission or renewal was not granted. Removal is a separate decision to require departure. Failure to leave after refusal and expiry of the lawful period can lead to removal, but the decisions have different procedures and deadlines. Detention is another separate measure.
Act promptly
Record service, obtain the full decision, contact a registered lawyer, prepare personal/family/medical evidence, lodge within seven days and inform the issuing authority. Challenge detention separately where necessary and comply with any address/reporting conditions. Avoid unread signatures, false information, hidden previous decisions, missed deadlines or relying on an unregistered intermediary’s assurances.
