1) What does İfade mean?
It is a formal taking of a statement. You may be a witness (Tanık), complainant (Müşteki) or suspect (Şüpheli). Establish your status: the obligations and protections are different.
2) Treat it as an official record
A statement is not a casual conversation. Its written record may later be used in proceedings. Unclear wording, translation mistakes or an unintended admission can matter.
3) Language and legal assistance
Explain promptly if you cannot understand Turkish sufficiently, and request an interpreter. Ask to read or have the complete record accurately interpreted, and request correction of errors before signature.
A suspect must be informed of the allegation and relevant rights, including legal assistance and the right not to make a statement about the allegation. Rules on appointed defence counsel depend on the situation. Witnesses have separate duties and specific protections, including against self-incrimination; do not assume a suspect's general right to silence applies identically to every witness. See the Criminal Procedure Code.
4) What to prepare
- Your identity document, residence card or passport.
- The summons, case number and any explanation of the purpose.
- Relevant messages, payment records, photographs, contracts or invoices.
- A short chronology: dates, places, people and events.
5) Give an accurate account
If giving a statement, distinguish what you directly know from what someone told you. Say honestly when you are unsure or cannot remember. Ask for an unclear question to be explained or interpreted. Do not adopt another person's account or speculate about their intentions.
6) Avoid misleading or emotional explanations
Phrases such as “I was joking”, “I signed but did not mean it” or “they deserved it” do not resolve the legal issue. Do not make an admission merely because you feel pressured or do not understand. Obtain legal advice if an allegation is being put to you. Tell the truth; do not invent an account.
7) Before signing
Read the whole statement, check names, figures and dates, and ask for inaccuracies to be corrected. Ensure the use of an interpreter is recorded. Explain if you cannot understand the document; do not sign an account you have not understood.
8) When is prompt legal assistance needed?
Particularly when you are a suspect, the matter concerns forgery, threats, blackmail or assault, negotiable instruments are involved, or you are asked for a device, passwords or a broad undertaking. Ask counsel about the lawful procedure; do not destroy evidence or obstruct an authorised measure.
9) Three practical situations
- Witness: describe what you observed and raise any self-incrimination concern before answering.
- Complainant: organise the evidence chronologically and ask that your complaint be accurately recorded.
- Suspect: request interpretation and legal assistance as needed, and understand your rights before deciding whether to give a statement.
Practical takeaway
Establish your status, understand the questions and record, use appropriate language assistance and obtain advice promptly when there is an allegation or serious risk.
