Granting a Power of Attorney in Türkiye: Tasks, Limits and Documents

A vekaletname authorises another person to act on your behalf. It can be useful when you cannot attend a transaction yourself, but the written powers determine what the representative can do. Do not treat a broad document as a routine formality.

1. What the document does
A notarial power of attorney identifies the principal and representative and sets out the authority granted. Its scope may be narrow or broad, and it may include an expiry date. The required form and any special powers depend on the transaction.

2. Common uses
  • Buying or selling property, collecting a title deed or completing related procedures.
  • Carrying out a banking transaction where the bank accepts representation and the wording meets its requirements.
  • Vehicle transfers, insurance or relevant official procedures.
  • Submitting files or collecting documents from public bodies.
  • Appointing a lawyer for the specified proceedings or objections.

3. Common types
A general power gives broad authority; a special or limited power concerns a defined task. Lawyer and property powers need wording suited to their legal purpose. A title such as “special power” is not enough if the clauses still grant extensive financial or disposal powers.

4. Define three things
Identify the task, the intended duration and the restrictions. Consider whether the representative may sign a final agreement, sell an asset, receive money or appoint someone else. Use limits suited to the transaction while retaining the powers needed to complete it.

5. Drafting checklist
  • Describe the transaction and any property, vehicle or document accurately.
  • Distinguish authority to submit or follow up from authority to sign or dispose of an asset.
  • Discuss an appropriate expiry date or completion limit.
  • Address receipt of money explicitly if it is unnecessary or should be limited.
  • Avoid combining unrelated purposes merely for convenience.

6. Preparing for the notary
Confirm the accepted identity documents, any required translation, photographs and supporting transaction records. Bring the representative's full identifying details. If you cannot understand the proceedings in Turkish, arrange the required sworn interpreter. Property and vehicle procedures may require precise registry information.

7. Mistakes to avoid
Read and understand the entire document before signing. Check names and identifying numbers. Do not grant financial, sale or final-signature powers unintentionally, or leave temporary authority broader or longer than needed. Keep a copy and the notarial reference.

Common questions
Is a power of attorney always necessary? No. You can often attend personally, subject to the procedure's rules.
Is a general power better because it covers everything? It may be convenient, but it also permits more actions. Choose the scope based on the actual task and obtain independent advice for a sensitive transaction. No template can guarantee that a document is risk-free.
