Foreigners’ Rights during Police Stops, Custody and Questioning in Türkiye 2026
Foreign nationals have basic procedural rights when dealing with the police and prosecutors. Those rights do not disappear because someone is not a Turkish citizen or has limited Turkish.

Understanding the procedure
- Durdurma: a temporary stop for a lawful check or prevention of danger.
- Kimlik sorma: a request for identification.
- Yakalama: apprehension or arrest under the legal conditions.
- Gözaltı: custody during a criminal investigation.
- Tutuklama: remand in custody ordered by a judge.
- İdari gözetim: immigration-related administrative detention, a separate procedure.
Stops and identity checks
Article 4/A of the Police Duties and Powers Law permits stops and identity checks for legally specified reasons. A stop should last no longer than necessary for its purpose.Remain calm, show your residence card, passport or appropriate identification, ask politely why you have been stopped, provide accurate information and avoid physical resistance. Afterwards, record the place, time and any witnesses while events are fresh in your memory.
Arrest and custody
Ask why you have been arrested, what offence or suspicion is involved, where you will be taken, when the arrest and custody began, and the file number or prosecutor's office where available. The ordinary custody limit is 24 hours from apprehension, excluding necessary transport to the nearest judge or court, which may not exceed 12 hours. Different statutory powers and written extensions can apply to collective offences or specified investigations. A lawyer should check the particular procedure and any extension order.
Your right to a lawyer
A suspect or accused can choose a lawyer, request appointment under the legal rules, consult the lawyer and obtain assistance during statements and questioning. Confidential consultation is protected under the applicable legal provisions.Say: Avukat istiyorum — “I want a lawyer.” Requesting representation is an exercise of defence rights, not an admission.
The right to remain silent
A suspect must be informed of the right not to give an incriminating account and may refrain from answering questions while seeking legal advice. This does not authorise false identification, obstruction of a lawful order, resistance or destruction of evidence.
Interpretation
If your Turkish is insufficient, request an interpreter. Do not rely on someone connected with the opposing party to interpret an important criminal statement.Say: Türkçe bilmiyorum. Tercüman istiyorum — “I do not speak Turkish. I need an interpreter.” You should understand the allegation or reason for questioning, questions, rights and full content of the statement before signing.
Discussing documents during a legal consultation
Before signing a record
Read it or have it accurately interpreted. Check that it records what you said, ask for errors to be corrected and objections recorded, and ask for your requests for a lawyer or interpreter to be documented. Do not sign blank papers or a waiver whose consequences you do not understand.
Relatives and consular contact
The law regulates notification to a relative or a person designated by someone arrested. Foreign nationals may request communication with their diplomatic or consular mission, subject to applicable agreements and rules. State your nationality accurately, ask for the consulate to be informed if you wish, identify a trusted contact and request an impartial interpreter.
Medical examinations
Medical checks take place at specified stages of arrest and custody. Tell the doctor, as privately as possible, about existing or recent injuries, chronic illness, essential medication, pain, assault or an acute mental health problem. Ask for visible injuries and symptoms to be recorded accurately.
Immigration consequences
A criminal investigation does not automatically cancel residence or lead to deportation. Conversely, release from criminal custody does not prevent a separate immigration procedure. If you receive a deportation decision (sınır dışı etme), administrative detention order (idari gözetim), transfer to a removal centre or entry restriction, obtain the written decision and check the remedy and deadline immediately.
Actions to avoid
Avoid physical resistance, bribery, false identity or address details, deleting phone data after an investigation starts, and signing an untranslated statement. Do not confuse criminal custody with administrative detention or rely on verbal assurances when a written decision can be requested. Silence does not remove the value of legal representation.
Details to give a trusted contact
Where you can communicate, provide the station or location, approximate arrest time, name as shown in your passport, foreign identity or passport number, lawyer's details, urgent medical needs and any request for consular contact.
