👷 Employment Disputes in Türkiye 2026: Wages, Dismissal and Mediation

1) Common problems
  • Late or unpaid wages and overtime.
  • Unclear terms or work without a written contract.
  • Sudden dismissal or pressure to resign.
  • Unpaid termination entitlements or accrued holiday pay.
  • Work-permit or social-security registration problems.

2) Build an evidence file
Keep your contract, wage transfers and statements, attendance records or shift messages, emails and messages with management, and insurance or registration documents. Without a written contract, other evidence and witnesses may still be important. Do not access records unlawfully or remove confidential material unrelated to your claim.

3) Pressure to sign a resignation
A resignation letter or release can affect your case. If you are being dismissed or pressured to leave, understand the document before signing, ask for a copy and preserve written evidence of what happened. Whether a resignation is legally effective depends on the facts and applicable rules.

4) Mediation before court
Mediation is a prerequisite for many employment claims, including employee or employer payment and compensation claims arising from an employment contract, and reinstatement claims. Exceptions apply, including certain occupational-accident and disease claims. The Ministry of Justice's mediation guidance explains the scope. Missing this requirement can result in procedural dismissal.

5) A practical route for unpaid wages
  1. Send a clear written demand identifying the unpaid amount and period.
  2. Assemble the employment, attendance and payment evidence.
  3. Apply for mandatory mediation where required if the dispute is unresolved.
  4. If no agreement is reached, retain the final mediation record and take advice about a court claim and its deadline.
A private payment demand does not necessarily suspend a legal time limit. Act particularly quickly if seeking reinstatement after dismissal.

6) During the first week
Preserve evidence before access to work systems ends. Follow important verbal discussions with a factual written record. Avoid threats, and check the effect of termination on your work permit and immigration position before making a decision.

7) When to seek legal advice promptly
Do so for substantial claims, disputed dismissal, a proposed resignation or release (İbraname), a sensitive permit situation, or allegations against you. A payment claim and a permit problem may require separate procedures.

Message about unpaid wages
Code:
Hello,
As of [date], my salary for [month/period] remains unpaid, together with [overtime/accrued holiday pay, if applicable].
The amount I calculate as outstanding is [amount]. Please arrange payment by [requested date] and provide a written explanation for the delay.
Thank you.
The requested response date is your proposal, rather than a statutory deadline.

Practical takeaway
Support your claim with records, make the demand in writing and check whether mediation is required. Obtain advice before signing away rights or allowing a deadline to expire.
