Marriage, divorce and the documents used to record them can affect residence, finances and children's arrangements across more than one country. Identify the procedure you need before preparing or paying to authenticate documents.
1. Establish what you are trying to do
- Have a legally recognised marriage ceremony in Türkiye.
- Register or use documents for a marriage that took place abroad.
- Arrange family residence, children's records, maintenance or another family matter.
- Obtain a divorce or resolve the consequences of separation.
2. Getting married in Türkiye
For a marriage before the Turkish authorities, the usual preparation is:- Collect both parties' identity and passport documents, any relevant immigration records and evidence of marital status or capacity to marry.
- Confirm which foreign documents require authentication and Turkish translation, and whether the translation must be notarised.
- Submit the application to the competent marriage office. NVI identifies municipal marriage offices and authorised population directors as competent where a spouse is a foreign national.
- Obtain the required medical report and complete the remaining local application requirements.
- Arrange the ceremony and attend as required, using an interpreter if needed and in the form accepted by the office.
- After the marriage, obtain the relevant certificates and complete any necessary notifications, address changes or separate family residence application.
3. The document most likely to delay an application
The certificate confirming marital status or legal capacity to marry may be called a certificate of no impediment, a certificate of capacity to marry or another name in the issuing country.Check its accepted issuing authority, issue date, required information and authentication method. The receiving office must be able to connect the document to the same person identified in the passport. Use the passport's Latin-script spelling consistently and ask how any genuine spelling or name discrepancy should be documented.
For certain protection categories, NVI provides for capacity-to-marry documents based on records held by the Provincial Directorate of Migration Management. Do not assume that every applicant must obtain the same document from a home-country consulate.
4. Using or registering a marriage celebrated abroad
You may need the marriage certificate for a residence application, insurance, banking, children's records or another official family procedure. Obtain the original or an accepted certified extract and establish the authentication and translation requirements of the authority receiving it.Using a foreign marriage certificate and registering a marriage in a Turkish population record are different procedures. If a Turkish citizen is involved, ask NVI or the Turkish mission about the applicable civil-registration notification. Foreign spouses should check what is required for their own residence and administrative files. A translation alone does not complete every registration or recognition requirement.
5. Divorce: three questions shape the case
- Is the divorce agreed or contested? Agreement on separation does not necessarily settle every financial or procedural issue.
- Are children involved? Custody, contact and child maintenance need properly considered arrangements.
- What financial issues remain? These may include housing, maintenance, compensation claims, property, debts and any claimed marital payment obligation.
A private agreement does not itself dissolve the marriage. Where the Turkish courts have jurisdiction, a divorce requires the appropriate court procedure. An overseas divorce may also need recognition, enforcement or an available civil-registration procedure before all its effects can be relied on in Türkiye.
6. Protect your position
- Put proposed maintenance, contact, housing and settlement terms in writing, with clear amounts, dates and responsibilities.
- Seek advice on the approval or formalities needed to make the arrangement effective. Children's welfare and applicable mandatory rules cannot be displaced by a private agreement.
- Use traceable payments and describe their purpose accurately, especially maintenance payments.
- Keep contracts, invoices and other lawful evidence of assets, liabilities and contributions.
- Do not sign a broad release, waiver or settlement you do not understand. Obtain a reliable translation and independent advice where necessary.
7. Children's arrangements
Custody, contact and maintenance should be specific enough to work in everyday life, including handovers, school holidays and payments where relevant. They remain subject to the applicable law and the child's welfare. Before travelling internationally with a child, check parental consent requirements, court orders, passport arrangements and the destination country's rules. Removing a child across a border without the necessary authority can have serious legal consequences. If the parents disagree, obtain advice before booking or travelling.
8. When specialist or urgent help is needed
- Threats to remove or conceal a child or prevent all contact.
- Pressure to sign a comprehensive waiver or hand over documents.
- Violence, threats, blackmail or being prevented from leaving the home.
- Different nationalities, assets or proceedings in more than one country.
Keep both the documents and the legal effects clear
Confirm the correct procedure, prepare consistent identity documents and obtain advice before signing terms that affect money, residence or children. Clear written records help, but the appropriate registration, court approval or recognition process may still be required.
