What does mandatory mediation mean?
For specified disputes, applying to mediation is a prerequisite to filing a court claim. An independent registered mediator helps the parties explore agreement. The requirement to apply does not force you to accept a settlement. If no agreement is reached, a final record is issued for the next procedural step.
Which disputes are commonly covered?
The applicable laws cover defined employment, commercial, consumer and rental disputes, together with certain other areas. Their scope and exceptions differ. Not every civil money claim is subject to mandatory mediation, and certain eviction enforcement procedures are excluded. Criminal investigation and criminal-law conciliation follow separate rules. Check the Ministry of Justice's official FAQ for the applicable category.
What happens during mediation?
- An appropriately registered mediator is appointed through the relevant process.
- The parties are contacted and meeting arrangements are made.
- Each side explains its position and the relevant information.
- The mediator facilitates discussion without acting as a judge or imposing a decision.
- The outcome is recorded, whether there is agreement, partial agreement or no agreement.
If an agreement is reached
An agreement can have important binding and enforcement consequences. The requirements for treating it as an enforceable document depend on the dispute and signatures; some situations require an enforcement endorsement. Do not assume every signed page has identical status.
Before signing, check whether the document finally releases claims, sets clear payment amounts and dates, includes default terms, and covers all claims or only specified parts. Obtain legal advice if the effect is unclear.
If there is no agreement
Keep the final mediation record. In a case requiring mediation, it is normally needed for the court application. Check the remaining filing period promptly; the mediation process does not give an unlimited extension.
What to prepare
Bring the contract or evidence of the relationship, payment records, dated correspondence, a clear calculation of the claim and a realistic settlement proposal. Know both your preferred result and the minimum terms you would consider. Confirm any representation authority and anticipated costs.
Common mistakes
Arriving without records, demanding an unexplained figure, signing vague terms without dates, or turning the meeting into a personal confrontation can obstruct a useful outcome. Do not ignore an invitation without advice: attendance and costs can have procedural consequences.
Practical takeaway
Mediation can resolve a dispute earlier, but preparation and precise wording matter. Check that the requirement applies, understand the document and retain the final record.
