1️⃣ ⚖️ Work Permit Refusals, Objections and Cancellation in Türkiye in 2026

A first application can be refused, a renewal can be refused, or a permit already issued can be cancelled. The effects and next steps differ. An interested party may object to the Ministry’s refusal, cancellation or termination decision within 30 days of service. Refusal objections are submitted through e-İzin with an explanatory petition and supporting evidence.

The official e-İzin sign-in for work-permit applications and follow-up is the Ministry’s portal.

2️⃣ Refusal to renewCheck when existing permission ends

3️⃣ 📌 Refusal, cancellation and expiry

  • First application refused: no new right to work arises.
  • Renewal refused: the permit is not extended. A temporary right to continue while a timely renewal is assessed ends when the refusal is issued.
  • Cancellation: an existing permit is brought to an end before its scheduled expiry, on request or for a statutory reason.
  • Expiry: the permit reaches its end date; a valid, timely renewal application is needed to use the limited continuation rules.

4️⃣ 📋 Statutory refusal grounds

Article 9 of International Labour Force Law No. 6735 provides grounds including:
  • 1️⃣ 9(a): labour force policy. The proposed employment does not meet the applicable international labour force policy.
  • 2️⃣ 9(b): false or misleading information. Examples include altered qualifications, inaccurate contracts, concealed material facts or misleading company and financial records. Forgery can also lead to criminal proceedings.
  • 3️⃣ 9(c): insufficient justification. The employer has not adequately explained the need for the foreign worker or the link between the worker’s skills and the role.
  • 4️⃣ 9(ç): a profession reserved to Turkish citizens. Restrictions cover specified legal and notarial work, dentistry, pharmacy, veterinary work, tourist guiding, private security, accountancy and certain maritime or other occupations. Check the law governing the exact profession and the current official list.
  • 5️⃣ 9(d): insufficient qualifications. Required education, experience, equivalence, registration or professional approval has not been established, particularly in regulated fields.
  • 6️⃣ 9(e): evaluation criteria not met. These may concern Turkish employee numbers, capital, sales or exports, the salary threshold, a foreign partner’s stake, sector rules or the evidence for an exemption from criteria.
  • 7️⃣ 9(f): entry, visa or removal grounds. The Ministry of Interior identifies a relevant situation under Articles 7, 15 or 54 of Law No. 6458.
  • 8️⃣ 9(g): public order, security or health. The competent authorities identify an applicable impediment.
  • 9️⃣ 9(ğ): nationality-related restrictions. The relevant rule concerns nationals of states not recognised by Türkiye or with which it has no diplomatic relations, unless the Ministry of Foreign Affairs gives a favourable opinion.
  • 1️⃣0️⃣ 9(h): procedural deficiencies. A late application or missing information not supplied within the prescribed period can result in refusal. The period for supplying deficiencies is normally no more than 30 days, subject to an officially substantiated force majeure exception.
Use the current official evaluation criteria rather than an old checklist.

5️⃣ 💳 Payment after approval

The permit fee and valuable-paper/card charge must both be paid correctly. Failure to pay the notified charges within 30 days of notification results in rejection and no card being issued. Payment of only one charge is insufficient.

6️⃣ 📧 Keep the decision and service evidence

The result is sent to the registered email address and is visible in e-İzin. For an overseas application, it is also notified online to the relevant Turkish mission. Retain the full decision, legal service date, application number, refusal article or code, submitted documents, requests for missing documents and submission acknowledgement. The objection period runs from legal service, not from when you later remember to check the result.

7️⃣ 💻 Submitting an objection

Use the employer’s or authorised representative’s account to open the refused application, select the objection procedure, upload a detailed petition and evidence, complete the required electronic signature and save the submission receipt and reference number. An ordinary email or telephone call is not a substitute for the prescribed online objection.

Identify the employer and worker, application number, decision date and number, service date and refusal provision. Give a concise chronology, answer each ground, refer to the supporting documents and expressly request reconsideration and withdrawal of the refusal. A general request to “look again” without addressing the legal reason is unlikely to resolve the problem.

8️⃣ 🗂️ Match the evidence to the reason

  • Staffing or financial criteria: current SGK employee records, approved financial statements, paid-up capital and trade registry evidence, sales/export documents and proof of an applicable official exception.
  • Salary: a corrected contract, the required gross salary commitment, previous payroll for renewals, SGK records and bank payments.
  • Qualifications: diplomas, experience records, equivalence where required, certified translations and the competent professional authority’s approval.
  • Business need: a detailed job description, explanation of the company’s need, relevant projects/contracts and evidence of the specialist skills or languages required and their contribution to production, exports or investment.
  • Missing documents: supply the document, evidence of timely submission where relevant, and documentary proof of any technical failure or force majeure relied on.

Organising documents and an online application

9️⃣ 🔄 Object or make a new application?

An objection may be appropriate if the decision used incorrect facts, overlooked a document, misapplied the law or calculation, or failed to recognise an exception that already applied. A fresh application may be better when staffing, capital, salary, role, qualifications, employer or contract changed only after the original application. The Ministry confirms that refusal does not prevent a new application once the deficiency is corrected.

1️⃣0️⃣ 🚫 An objection does not authorise work

An objection does not create a permit or automatically revive one that has expired or been cancelled. Do not start work following a refused first application. Stop when a renewal is refused and no valid permit remains, or when a cancellation takes effect. Continuing without permission can lead to fines and a referral for removal procedures.

1️⃣1️⃣ ❌ Grounds for cancellation

A permit or exemption ceases at expiry or through cancellation. Cancellation can follow the worker’s or employer’s request, failure to enter Türkiye within six months of the permit start date, failure to maintain passport validity unless exceptionally approved, unlawful use of the permit, termination of employment, false documents or information, or relevant entry/removal or public order, security or health grounds.

Other statutory grounds concern failure to supply information or retain eligibility during the Turquoise Card transition period, and prolonged continuous absence without accepted force majeure: more than six months for a fixed-term permit, more than one year for an independent or permanent permit, or the Ministry’s specified limit for a Turquoise Card. Check the exact statutory ground and any applicable exception in the decision.

1️⃣2️⃣ 🧑‍💼 When employment ends

The employer should complete the employment termination lawfully, request cancellation or termination of the permit, notify the Ministry within 15 days where the reporting duty applies, and submit the SGK exit notice within 10 days. Pay outstanding wages, unused leave and any compensation due, and give the worker termination records. The Ministry’s documents page includes a cancellation/termination petition form.

1️⃣3️⃣ 🛂 Residence consequences

A work permit generally substitutes for a residence permit while valid, with exceptions for certain protection categories. Cancellation may therefore remove the basis for lawful stay if no separate residence permission or other status exists. Check with Migration Management immediately, consider whether a lawful switch of residence category is available, stop work and comply with any departure deadline. YİMER 157 can provide procedural information. Refusal of a new work application does not necessarily cancel an independently valid residence permit.

1️⃣4️⃣ 🏛️ Administrative court proceedings

If the Ministry rejects the objection, administrative judicial review is available. The general time limit for an administrative annulment claim is 60 days unless a special rule applies; calculating the remaining period depends on service and the preceding objection procedure. Filing a claim does not itself restore the permit or suspend cancellation. A stay of execution must be sought separately and its statutory conditions met. Obtain prompt legal advice on the actual decision and dates.

1️⃣5️⃣ ✅ Before submitting

Check the 30-day limit, the exact refusal ground and current criteria. Reconcile SGK, salary, trade registry and financial records. Answer each ground with legible evidence, sign and submit through the required system, and save the receipt. Continue working only while a valid legal authorisation permits it.
